I just wondered that when the two sides' medical experts agree about everything apart from one significant point, how likely it is that they'll settle out of court?
Neither will budge on the issue so is it more likely that it will be for a judge to decide?

If it is a significant point, in that it will change the outcome of your case, or has the potential to, then yes, I think it unlikely that they'll settle out of court.

From your solicitor's point of view, it's unfair to reduce your claim for compensation by ignoring a significant point.

From their solicitor's point of view, it's unfair that their client would be asked to pay a penny more than the facts of your case support.

Obviously, the fact in question is the piont they can't agree on.
