Can a Council Tenant move in their partner legally if partner is a homeowner?

Do not want to move in with him as DS's school and work are nearby BF lives on otherside of city. I do not claim benefits and work full time as does he so no benefit fraud involved.

He will let out his property but will need to pay council tax at my place (i will loose 25% discount as a single adult)

He will not become a joint tenant though the tenancy will remain in my name.

Is this legally OK?

Does it change if we decided to get maried in the future?

Want to do things right but do not want to give up my flat Not at the moment anyway)

I work in Housing - as already suggested, it's absolutely fine. If you marry there is still no need for him to become a joint tenant and in fact as this would create a new tenancy agreement you may find that you lose some rights or even move to 'target rent'. You may also lose one right of succession which is your right to transfer the tenancy to a partner or child when you die. Some local authorities are moving to flexible tenancies which do not guarantee a tenancy for life as is now the case. If your relationship did eventually break down you may have to vacate your current property, especially if this took place after any children left home.

So for all these reasons my advice would be don't be tempted to change to a joint tenancy!

All of the above can vary from one local authority to another - best advice is phone your Housing Officer for an informal chat. Smile

Check the terms of your tenancy agreement. I think it unlikely that any council would prevent your partner moving in, but you may be required to notify them that he is living with you.
