Stopping contact due to threats

Hi I am new to mumsnet so forgive me if I don't understand some of the jargon and etiquette to be used. Basically my daughter is having severe problems with her ex who wants contact with his son. To cut a very long and awful story short, we have been to court and he was granted weekly acces faciltiated by me. However over the last few weeks things have gone downhill and resulted in his family threatening us with violence. I have therefore stopped taking the child to the contact sessions. Can the court force us to go even if we have been threatened? And if we continue to refuse what are the consequences?

Have you reported the threats or is it a case of your words against theirs?
If access had been happening and court ordered previously they might take a dim view of suddenly going against this if no threats or threatening behaviour has been recorded

I disagree Kayano. OP can pull out whenever she wants and doesn't have to give a reason. the court will try and replace it with contact that will work - either at a contact centre or unsupervised - but the answer to the question OP is the court can't force you to do anything.

Where is the contact happening?

cestlavielife · 08/12/2011 12:37

have you reported the threats to the police?

and where is contact happening? if in a contact centre then cant see why you would not take the child there as you should be protected...

Thanks for the replies. Just to update you we went to court yesterday and the judge ruled that as threats were alleged (and in light of a very damning report from social services) that contact be stopped until another full hearing in the New Year. We were very relieved. I think at the next hearing contact at a contact centre will be ordered but this brings other problems - is far away and in the middle of a housing estate so means round trip of 5 hours and the possibility of meeting him as only one bus per hour. We think that this is unreasonable. What do you think?

This is the nearest one unfortunately. Will see what happens when back in court in the New Year.
