Internet Slander Law Question??

I'm in the middle of a wrangle with a company over the stupidly late delivery of items (over a month & still not even a date) & totally rubbish response to e-mails, calls etc etc - I've had to chase them all through, even though they added a note excusing late delivery AFTER my order went in Angry - my order is now later even than the NEW expected time spanHmm

So I've been digging around further trying to find out just how safe the company are, as its not a small amount of moneyAngry & find a review type advertising site for them Grin

so I leave a review, obviously not a good one,

but it IS honest in that I've said I can't offer a appraisal on the actual goods, as still after chasing & chasing, I haven't received my delivery, & generally slating their rubbish customer service

Might be hilarious really as I haven't been able to get reasonably timed response of more than a 1 line grunt, with half the information I've ask - ie are we getting the advertised deal, as nothing shows saying so on my paper workHmm & still no real delivery date in well over a month - they just keep sending out the same e-mail - ie: you'll hear in 2-3 daysHmm

but it took them half an hour to contact me over my review & threaten to sue me if I don't delete itAngry I've stood my ground & informed them that I won't be removing it until my refund is safely back in my accountHmm

I just wanted to double check the point of law - am I right in thinking that as my review is honest & I can back that with their/my e-mails etc, they cannot sue me????? - at least not sue me & win, so would need to be daft to even try?

If it's true, they are being arseholes and you should treat them accordingly.

but thought it sensible to double check there hadn't been some weird change in law as regards internet - the numpty who's threatening me, seems to think there is -- haha thanks again:)

You can't get in to trouble for telling the truth. There's also the defence of fair comment.

Thank you, thats what I had thought too, so I've nothing to worry about then,

& thinking on it, I won't be removing my company review even when I do get the money back - & thankfully we paid via paypal, so they can't not refund :)

Was this via ebay? If so, I think you can complain to Ebay about it, and perhaps add to your review how they have tried to silence you. Then you can add to the review each and every threatening letter they send you. Betcha they won't like that!

Have you checked paypal's refund conditions? There's a time limit I think and if the order had been delayed already you need to be careful....

Yes, thanks :) I read up on the paypal info last night

no Not e-bay, a company called Icube, though thankfully we made payment via paypal anyway

& we are within the 45 day time limit, though close to cut off the company has promised a refund on Monday, no idea why it can't be done today, or even yesterdayHmm but will wait until then & if not will up it it to a "claim back" as we will still be within time :)

the attitude of the guy we are dealing with is to put it mildly coming across as arrogant, but he seems to be backing down now we've involved paypal - I also suspect he may of checked the law himself & realises what an arse he was being in threatening to sue over my company review - he's now giving the its our loss as we would love his product -

maybe we would, but as it was a smaller test order, to check the quality was up to scratch & I've a much bigger order to place - he can swivel, as no way do I want the stress of dealing with such an unprofessional wassack again & would rather spend my money with someone who actually deserves it -

his latest line is, that its now up to 30 business days for despatch - ie 6 weeks, so he's still in the right, but I can have my money back Hmm -

different to when I bought, which was next day dispatch, or even his earlier e-mail, after my chasing having heard nothing, which then said 10 days -

I think they are a legit company, but with that kind of customer service I doubt they will be for long [shakesheadindisgust]

Their delivery information is a bit weird:

"All orders are delivered by UKMail on a Next Day service. Note: Due to high demand for our products orders are currently being dispatched within 10-30 business days."

Either it's next-day, or it's not. Or is it "next-day" once they've actually made the stuff and the couriers have collected, up to 6 weeks after you order? It's not clear, and it's extremely misleading.

AND they do that irritating thing of excluding large chunks of Scotland. Angry

they added the note bit & the 10-30 day thing AFTER - I think thats why it looks so weird - the business days was added later still

basically I'm guessing they've oversold themselves - from poking around the net, it looks as if they may have recently taken on sub contracts with a couple of other companies, which has boosted their sales & they can't cope - but instead f dealing with it in a professional manner - ie send out an e-mail to customers as soon as you know there may be a problem & ask for their patience etc - he seems to be just trying to hoodwink people into thinking he is right to send out as late as he needs & no apologyHmm - doubt he'll last long in business with that kind of customer care attitude

I do love the internet, its amazing what you can dig up - I've even found their manufacturer Grin

& yes, why DO companies do that with Scotland Confused I've heard Scottish friends complain of that before, must be bl@@dy frustrating

There was a whole thread about it recently! Grin The usual excuse is that it's because of the courier company. Well, duh, change your couriers! One friend unearthed a classic the other day, an eBay seller who used Royal Mail but wouldn't send to remote parts. I mean, why? RM are happy to deliver!

They can certainly sue you, but that doesn't mean they'd win. Just make sure your review doesn't go beyond factual things you can prove or comment on factual things you can prove.
