Insurance problem and liability

A neighbour's child has caused accidental damage to my car, don't want to say how or what in case I'm identifiable.

Anyway, it's going to cost a fortune to fix. Neighbour's mother originally said she would pay for the damage, but now realising it's could well be £1000's, is backtracking and she is going to see if she can claim on her household insurance.

Don't think she can as it happened on a public road and not on her (or my) property.

If she says she can't afford to pay, then what do I do?

Any legal/ insurance bods who cah help, tia.

There's not really a lot you can do, sorry. It's actually perfectly possible her insurance will cover it if she has public liability I think, but also possible that it won't, and if she refuses to pay you have little comeback, especially as it was a minor that caused the damage. Fingers crossed the insurance pays out for you!

You can actually sue the child (I've seen it done) and enforce it against the child when she/he's an adult. Would be a shitty thing to do though. Aren't you covered by insurance?

You may have to claim on your own fully-comp car insurance, but there's nothing you can do to reclaim the extra premiums this will cost you - or your excess.

It's a difficult area, just hope the child's mum is covered by her household insurance.

don't think I'll go down the suing the child route Smile

thanks everyone

I am fully comp, but I have maximum no-claims so that's that stuffed
