Car incident - advice please

A car hit me the other day - she got too close and scraped her wing mirror down the side of my car. Parked up, she apologised, we exchanged details.

When i got home there was a message waiting - she had called her insurance company and told them i had hit her! Can't imagine what's she claiming for - her wing mirror wasn't even knocked off.

There were no witnesses and I am just wondering what happens now it's my word against hers?

I don't want to claim for any damage done to my car - but I sure as hell don't want to pay out to her.

What are the insurance companies likely to do please? Confused

You must phone and tell your insurance company ASAP.

If it is one of those incidents when it would be difficult to prove then the chances are they will agree that each company will settle their policyholders damages.

Can I ask though why you don't want your damages to be reimbursed?

it may be that the other driver is at the limit of a protected NCD for accidents that are her fault Hmm

Thanks. Have told my insurance company the way it was. I don't want to claim - because it doesn't really count as far as damage goes - just a black line, which as the rain falls and the days pass is diminishing. I am just fearful that I'll end up paying her when she walloped me!

Is her car damaged?
If she claims from you she has the burden of proof.

ilovemydogandMrObama · 11/03/2011 16:52

And why is she contacting you directly? Is there a possibility she wants you to pay her so she doesn't make a claim? Can't think of any other reason why she would call you....

Most of her car was `dinked' in various areas - but as we were clearly a wing-mirror apart, I can't have made any contact with her body work. Her mirror left a line the full-length of my car - so that was the only point of contact. I can't imagine what she feels i did?!

Reassured by the `burden of proof'line tho Smile

Have you taken a photograph of the line made on your car?? It would back up your version of events.

canyou · 11/03/2011 22:41

Sooooynical is right take pictures and if you have a friendly garage locally ask them to have a look and get a quote to have it polished out'repaired' so the proof of damage is from a 3rd party iyswim.

I would always take phone photos of the incident at the time and if sneaky and quick enough switch my phone to secretly record and admissions the other party made! Unfortunately I am thick when it comes to fiddling with my phones bits!

Were you driving towards each other? Or were you stationary?
