likelihood of case ending up in court

DH injured wrist three years ago at work. His firm's insurance company would not settle case so court proceedings have been issue. The insurance company has now put in a defence which includes full admission of liability for the accident.

However they have still not offered any settlement figure.

I was wondering if there any personal injury experts here, as I wanted to know likelihood of having to wait til court date (prob 6 months) or whether insurance companies tend to settle to save money as they are responsible for their and our solictors costs.

If full admission of liability is made why would the insurance company allow it to go to court? My only experience is with car accidents but its the same principle. They will make an offer at some point and then your DH can reject or accept the offer. After a bit of to ing and fro ing an offer is usually made which is acceptable. If DH flatly refuses any offer made for any reason then it goes to court, but it is so expensive for the insurance company they avoid it at all costs. I assume your DH has some legal representation (union?) they will advise him.

Hi, yes they are likely to make an offer to settle at some point, they would be criticised by the courts if they didn't. If your DH is legally represented then they may suggest that he makes the first offer (v high!) to get the ball rolling. Either way, it's highly unlikely to go all the way to a hearing if they are accepting liability.
