Juvenile Conditional Discharge.

DS is applying to 999 call centre for job . " All previous convictions must be declared whether spent or not ".

16 years ago he was taken to court for being drunk in a public place( He was a young teenager). He was given a conditional discharge for 12 months.

No trouble since.

He is very worried that this will impact on his application. Is it something he should mention ? Or do juvenile charges not come under the "Rehabilitation of Offenders Act "?

As this job is in law enforcement the employer is allowed to ask about spent convictions, i.e. convictions such as this which your son wouldn't normally have to declare. Your son should declare this conviction. It will show up when the employer asks for a CRB check anyway. A previous conviction will not automatically bar your son from this job. It is up to the employer but I would be surprised if the conviction you mention would affect his application.

Thank you very much for your answer. Poor DS he is upset that this has come back and bitten him. I interview for posts that are exempt from the Rehabilitation of Offenders act and it would not bother me at all but he wanted to know whether because it was juvenile the case was different.

Some juvenile convictions become spent more rapidly than adult convictions, although the period is the same for conditional discharges, but I'm afraid they still have to be disclosed to employers entitled to ask about spent convictions.

However, he should try to relax. As I say, I would be very surprised if a conditional discharge 16 years ago for being drunk would bar him from a job in a 999 call centre.

For a job in a control room you have to put all previous convictions on the form. It would show up on an enhanced check anyway. If there is a problem with it they might ask him about it. That offence certainly shouldn't be a barrier
