Do i need a will?

A work colleague told me yesterday that if i die, its possible my XP (never married) would be in control of my money as it would automatically on my death go to my kids, and then he would be their next of kin so he would get control of disposing my estate? Is that right? It doesnt sound right? But without a will where would my money go?

not sure but i have an ex h and new dh and have kids with both so my issue was them,have been told to leave awill yes as things will be complicated otherwise.Dint want my dd's separetd or bought up by my ex.The law can be complicated on this subject so check it out,

Always always make a will. If you want you maoney and property to be divided in a particular way, it only gets donethe way you want it if you make a will.

Wills aren't too expensive. Mine was about £130 IIRC.

Hi Halfa, the way things stand at the moment, your children are your next of kin and so would inherit everything in trust.

In order to ensure that that money is properly used for the benefit of the children, it's important to make a will. You will appoint executors whose job it is to look after the trust funds whilst the children are under 18, 21 or whatever age you wish them to inherit, and in the meantime, allow whoever was looking after them (whether a Guardian appointed by you, or your ex husband) a reasonable amount of money, usually by way of a monthly direct debit, to cover their expenses.

I'm a will writer and would normally charge £85 for a single will, £140 for a couple.

You do need a will. You should nominate guardians for your DCs. If the XP is the children's surviving NOK he may well get guardianship - is this what you want? The guardian may also get day to day control of whatever the children inherit until they reach majority.

Everybody needs a will. It is important that your money goes where you want it to go, that you consider personal bequests (for example, a piece of family jewellery, or something for a best friend or godchild to remember you by). I also think that, once you have looked after your kids, everyone ought to think about leaving something, however small, to charity.

Just done mine which was a bit complicated as have to ringfence everything from a greedy exH. All left to kids, but with named trustees and done in such a way that he cannot take what belongs to the children. (probably won't stop him trying tho) Well worth the time, effort and cost. This way YOU decide what you want to happen. Good luck.

If you have kids and/or property, you need a will. It's the only way to make sure that your assets are disposed of as you wish.
