Help needed with neighbour breaking leashold agreement

HI There,

I know this is a long shot but one of our neighbours has started a new business in the property.

It is leasehold and it states clearly on the lease that the property is only to be used as a family home.

The noise of people coming and going and the constant noise of footsteps is awful.

Is there anything we can do?

Well assuming that you are not the freeholder, then presumably all you can do is notify the freeholder.

Depending on the nature of the business, then you could see if they should have received planning permission for a change of use. But I suspect that it is mainly (in terms of space) still being used as a family home? Roughly how many visitors/clients are coming each day? How long do deliveries take?

The property is managed. free

Its a new business so at the moment it is 1-2 people working up there all day.

NO deliveries but random meetings all week

Its very noisy from the constant moving around and banging and crashing - no sound insulation - its unbearable.

Do you know what the freeholder can do - I do not want to start a big row and make life even worse......

I don't know about the freehold issues but if there are employees working there or customers visiting for meetings then it is likely planning permission would be required.

Try phoning your local planning department and having a word with them. Noise and disturbance are things that would be considered if they are required to submit a retrospective planning application. It's also worth making a log of the noise and disturbance and speak to the environmental health dept so they have a record of it. They will either be able to do something within their legislation or will liaise with the planning dept if an application is made and you then comment on the application.
