Partial finger amputation

Hi there, am feeling rather shaky and terribly upset about an incident that happened on friday after taking my ds who is 3 swimming. I am not sure if I am posting in the right area but would be grateful to here from others who have had a similar experience or know of someone who has.
In the changing rooms after swimming whilst exiting the loos my poor darling got his little finger caught in the hinges of a heavy door and his finger was virtually amputated by it. He had to have emergency surgery and there is a significant risk he will loose the finger. I have now found that there are door hinge protectors to prevent such injuries for as little as £16 from screw fix. The pool is particularly popular with young children as is very shallow has soft play etc. I understand schools and nurseries have to install these protectors does anyone have any further info about this

Report the incident to the Health and Safety Executive.

can't advise on the possible legal issues but just wanted to say I hope your DS's finger heals well and he is not too traumatised (and you of course) by this

LucindaCarlisle · 30/08/2010 09:12

Did you report the incident to the management at the swimming pool at the time?

Go to see a solicitor ASAP and commence a claim for compensation on behalf of your DS.

Hi there,
thank you for all the replies. Tomorrow morning will be very trying, he is having his first dressing change and we will find out if the finger is still viable or whether he needs further surgery. I have contacted the Health and safety department for our local borough council and also received a phone call from the swimming pools management today. They apologized and asked further details about his management when he went into hospital. I asked him specifically about hinge guards after speaking to a friend (an architect) who said they were mandatory in schools and nurseries. He said (the representative from the swimming pools) they had considered them previously in relation to those doors but had not fitted them ?reason unknown. When I explained to him that I had contacted the HSE he changed his tune said that they would be fitted ASAP following discussion with his management. He also wants me to come in and sign a document relating to the incident. I cannot face the prospect of going near the place and feel wary, I do not want to enter into further discussions with their management...

Do NOT sign any documaent without having a solicitor check it first!

You do not have to go there if you don't want to either!

bigstripeytiger · 30/08/2010 19:19

I agree with Totoros. If you are planning on instructing a solicitor then they can deal with the pool management for you.

ArseHolio · 30/08/2010 19:21

No legal advice but good luck tomorrow, hope the finger is viable and ((hug!)) it sounds awful. Your poor DS Sad

mumoverseas · 30/08/2010 19:49

good luck for tomorrow at the hospital.
Agree don't sign anything yet until you've seen a solicitor

Lougle · 30/08/2010 20:47

It will be of little comfort to you, Aliway, but you might want to point out that this could have been prevented for as little as £34.75Sad

I do hope you have a good result tomorrow. DO NOT sign any document.

Aliway · 30/08/2010 21:24

Thanks everyone
