Advice on marrying an illegal immigrant!!!!

Hi everyone,

Me and my boyfriend have been together for almost two years now and love each other very much and we are thinking of getting married. I am british but he is from Brazil and illegal in this country. He initially came with a tourist visa but stayed when the visa expired. He has been here illegally for three years now. I don't know what to do!!!! I know that he will not get a certificate of approval to marry here since he is illegal so what can we do? If I go to marry him in Brazil how long would it take him to come home with me? I am also divorced and have a five year old daughter and I can't just leave the UK easily to live in Brazil with him!!! My daughter's father would not agree and even though I have full custody of her this is another court battle! Help please!!!

Go away, Lucinda. You are spoiling a very interesting and important thread.

The UKBA does not consider religious adherance when making their decisions, so religion is not important to them (I say this as a devoutly religious person).

Start a thread in Philosophy/Religion or AIBU if you want to debate it - but leave this thread for relevent comments.

Concerning the acquisition of the NI number, I don't think that it changes much.

The UKBA will have a profile of young men from newly industrialised countries who overstay their visas. They know that they will be working (the alternative being to beg), and will probably be doing so as legally as they can (ie by paying tax and NI). In order to do this, they have to acquire a NI number. It's all part of the package. Again, nothing will shock the ECOs.

It's not that paying for a NI number from a shady characcter makes the situation any worse. It is expected and par for the course.

My ex was an illegal immigrant. I was with him for 6 years. He had passport etc in false name. He went to prison for 9months for benefit fraud under that name. He served 3 months and came out on a tag. After that he worked undercover for the police and got indefinite leave to remain in return. Bizarre.

My point? I have no idea. But I'm very glad to know be married to a nice stable man with none of this history. My ex is settled too. Has two kids and his own business.

According to the UKBA he is an overstayer and now illegally in the country and illegally working, an offense for which his employer can be fined up to £10,000 for.

Now, he'll stand before him and try to enter the UK on a EEA family permit to a Bulgarian national.

This doesn't look good from their point of view and it's their point of view that counts.

They are not romantic, they do not care about your love or family or any of that.

They care about the laws of the UK: a) the person is an overstayer b) is the relationship with the OP genuine (yes, they will need to prove it) c) he needs to prove he can support himself for a period of 2 years without recourse to public funds. He needs to either have a job lined up and proof of this or some serious money. And adequate accommodation.

That's the bottom line.

And you need to see an adviser or solicitor before his work gets raided and he's removed.

ruddynorah that is quite a story indeed :) I don't know if marrying him in Bulgaria and bringing him on this EEA Family Permit is better than going to Brazil!

Please, warn him to be entirely truthful to the adviser or solicitor. It really won't do him any good to lie to this person or withhold the truth in any way.

He needs to come clean to this person.

He is not a criminal....he has not done anyone any harm! He has worked really hard and has paid taxes like everyone else....better than beg on the street!

Iva I sympathise with your position but being in the country illegally and working illegally is, well, illegal. So you won't win many friends with the "but he's not a criminal" line. He just hasn't been caught yet.

Good luck Iva Smile I can only echo advice of seeing a good immigration lawyer.

Just to clarify for some people, a lot of people enter this country and overstay their visa's BUT they do pay tax and work and don't claim benefits. Usually on fake NI's numbers and fake passports which are easy to get hold of. Employers are not fined as long as they have made the proper checks, and have copies of all their documents (loophole for not noticing forgeries)

Also lots of people on student visas who are only allowed to work 10/20 hours but just get 2 jobs. There are not a lot of checks on these things by the government.
