Problems with Anglian windows...help!!

I ordered windows and doors from Anglain back in May. On the day the surveyor came out he told me that the del time had gone from 6-8 weeks to 12/14 weeks. I explained that was not good due to other work we are having done.

He told me that it was ok, they would be insalled by August and made a note on the contract that they were to be del ASAP

Still not got my wondows, still no word on del dates so I cancelled the order.

I realise I will not get the £1500 deposit back but they are now saying as I signed the contract I am liable for a 25% cancellation charge as I cancelled after 7 days.

I ahve no proof of what the surveyor told me except the note he put on the contract.

What can I do?

So he only put "delivery ASAP" on the contract?

In that case, I don't think you have a leg to stand on. It's still two weeks until August.

They are now saying del at end of august!

For the first 7 days you had the right to cancel and recover your deposit. After that Anglian Windows are allowed to make a "reasonable charge". I'm afraid their promised delivery dates are not part of the contract.

I suggest you write to Anglian telling them that under the Sale of Goods Act 1979 and the Supply of Goods and Services Act 1982 you believe they are in breach of contract for not delivering the goods in a reasonable time. Say you are now "making time of the essence" and give them a reasonable deadline to deliver. The deadline you set must give them time to deliver, so a deadline of next Friday won't do. If they then fail to deliver they are in breach of contract. That means you are not liable for any cancellation charge and can demand return of your deposit.
