Iv decided to apply for child maintenance from my ex husband who I share 5 children with, what’s the chances of receiving it as he claims uc and pip he has the children Friday and Saturday night? I know he’s gonna kick off Iv tried to apply

When on benefits, I think he just has to pay a flat rate of £7 a week but CMS will check it and see if is has to pay anymore.

If he's on UC then you'll get £7 a week at most. If he has them at least 2 nights a week every week that will be reduced.

As he has them 104 nights a year he may get a reduction on that as I think that's into the second band on the calculator.

What? Seriously is that what you would get to maintain 5 kids per month? Do the government expect you to sell your body to raise them? OMG. I am very luckily not in that situation but my god I did not realise that that is all an ex would have to pay towards the upbringing of his kids. Outrageous.

The thing is that uc is calculated as the minimum amount needed for a single person to live on. If the op was on uc she would get additional amounts for at least two of the children. PIP is for the additional costs of disability so is not usually taken into account in any calculations.

Because he is on benefits. If he was working then it would be a percentage of his income.

As others have said if he is on UC then you’ll get £28 a month realistically, probably not worth the kick off if at all avoidable!

Did you miss the bit about them being on UC and disabled?
