I didn't think you were allowed to sell organs therefore the organ has no value to be reclaimed....

I imagine that the kidney will be treated as a gift? He cant give it away at the time, and then try and get money for it later.

I think the point is that he knows it cannot be given back, so a monetary value should be assessed.

He sounded rather heart broken on the radio.

this has a slightly different slant and if the lack of access is true, then you could say he's trying to prove how ridiculous its getting.. I don't think he honestly wants it back, more to kick up a fuss about not seeing his kids

I would imagine that giving the kidney back would be tantamount to a death sentence, and giving compensation would be tantamount to selling the organ, so therefore, as it says in the linky posted by NutterlyUts, 'Manhattan attorney Susan Moss said, "the good doctor is out of luck and out a kidney"'.

That said, it does seem to be a lot more than just about a donated organ, after all she is the mother of his children and I'm sure that not even the most acrimonious of divorces would truly wish the other partner dead.

tomarto, i had never heard of that expression but I will definitely try to remember it.

ilovemydog I suspect you might be right but then again, how do you put value on this? on one side it seems a ridiculous amount of money, on the other hand life is not something you can put a price on.

What's next? one day divorcing people will have to pay compensation on dreams shared that never came true.... or is it already the case?

Cant believe a lawyer is even representing him. Surely they will get laughed out of court? If it is allowed I persume it will open the floodgates for everyone who has ever donated a organ to demand compensation, and create a loophole so organs can be sold. Complete and utter madness

He isn't a happy chap as he saved his wifes life by giving her a kidney and then she went and had an affair with another bloke and left him.....

He said though he gave her the kidney so that his children would have a mom, he doesn't actually want the kidney back really he just wants the compensation of one and a half million.

The figure comes from insurance and that is how the kidney is valued.

Not sure either on this one?

She wouldnt have died immediatly though - she would have had dialysis and stayed on the transplant list.

It was his choice to donate, very generous and IMO not one that he should be seen as being obligated to make.

He should have known at the time that it was an unconditional gift though.
