This is so shocking.

Why would you ride straight into someone regardless as to whether you had right of way?

OP posts:

Beanie - no-one is bashing cyclists in general.

They're discussing a single cyclist who killed another person. In the nicest possible way, if you're going to take it personally then best not to read maybe? I tend to stay away from dog threads for that reason.

OP posts:

"Howard was cycling on the road when he approached the group but the court heard conflicting evidence about whether he mounted the kerb at any point during the incident. "We think Rhiannon was probably a few inches, or a foot, in to the road and then she moved towards the pavement." "

beaniesteve · 10/07/2008 17:31

Gosh - I am not taking it personally. I am just saying that I can see why this man was not tried for Murder or Manslaughter. I can see why he chose to make this error in Judgement, I can see why the family are upset but I also think some of the posts shouting for a jail term are a bit over the top.

this happened because of a combination of things and when the OP was made not all the facts were out.

LittleBella · 10/07/2008 17:31

Beanie, even if she were on the road, he should have stopped.

It is not anti cyclists to say that. Cyclists do not have the right to plough into pedestrians.

LittleBella · 10/07/2008 17:33

"A bit over the top"

A child is dead. Because he didn't stop.

FFS. I don't know what else the guy was supposed to do, to deserve a jail term. He wilfully chose to put the pedestrians in danger. Of course that deserves a jail term.

So if I want to kill someone I hate all I have to do is run them over on my push bike and pay a small fine....god I love British Justice.

Some prat on a bike shot through the red light as DS2 and I (and some other parents and kids) were crossing for school

When I ride my bike I follow the high way code so why do others think if they are on a bike they are a little god and the rules don't apply to them?
I think bikes should be taxed and have to have insurance same as cars TBH.

iBundle · 10/07/2008 17:38

level of fine is pitiful

less than half the cost of his bike

TeacherSaysSo · 10/07/2008 17:46

"So if I want to kill someone "

kimi thats the differende between murder and manslaughter. The cyclist did not wake up that morning with the aim of killing someone.

As cod said earlier we all make errors of judgement when on the road, if everyone jumps up and down shouting for life sentences the jails will be full of a lot of law abiding people who made a human error. These will have to exist alongside real violent nasty criminals...are you sayng there isn't a difference? Now that would be a scarey world, thank goodness these proffessionals judge by the law and not emotion.

Kimi · 10/07/2008 17:48

TSS I will say I never meant to that it was an accident!!

I do think that a fine is pityfull its manslaughter at least, if he was in a car it would be

TeacherSaysSo · 10/07/2008 17:51

kimi did you have someone in mind???

Kimi · 10/07/2008 17:53

No but just in case

AtheneNoctua · 10/07/2008 18:20

Oh no....

Kimi, I am so sorry if I have said anything to offend you. REALLY REALLY truly sorry. Please accept my most humble apologies...

I do think this man didn't go to jail because he was a cyclist though.

If the cyclist had been in a car driving along and saw a girl in the road and shouted out of the window "i'm not stopping" and ran her over anyway even though he saw her and could have stopped, he would have gone to jail. So why is it different for a cyclist?

edam · 10/07/2008 20:58

Very good point, Nappy.

I read he was on the road when he hit her, also the story I read last week made me think there was more to it than in this one. It hinted that there was a group of them on the pavement and in the road, drinking alcohol and not moving. I did wonder if they were almost playing chicken and thinking it was funny to make the cyclist move further out into the road. While he could and should have done one of her group said she had plenty of time to get out the way and didn't.

edam · 12/07/2008 17:14

If that was the case it would have come out in court and have been reported. The BBC didn't mention it in the original story so I'm inclined to think it wasn't - they are more careful than most news organisations to stick to the facts.

And if they were blocking his way, why the hell was he riding straight at them at 17mph? Self-preservation would dictate you'd stop and dismount, or swerve.

MsSparkle · 12/07/2008 19:26

I do wish people would stop comparing car drivers and cyclists. Car drivers do bad things on the road and so do cyclists, they are as bad as eachother.

Fact is, a girl has been killed in this case by a cyclist who could have stopped but didn't. There is no use saying that car drivers kill X amount each year, what are people suggesting, a man gets off killing someone on his bike because car drivers kill more people.

What a lame argument.
