Seemed to be a very brief re-examination of Brand yesterday. I thought his KC would have focused more on the inconsistency of his interviews with the police vs what he said in court yesterday. I thought that really undermined his credibility.

This is one for @easteggwho is the expert (as a former practitioner in crime).

@ItalianChips judges’ guidance these days tells them to keep it simple when directing juries about this. It’s ‘satisfied so that they’re sure’. Expressions like 100% are not helpful and judges are told to not use them. One guide that used to be used and I think it’s still valid is ‘as sure as you would want to be about an important decision in your own life’. Doubt means reasonable, not fanciful.

Isn't it about seeing seeds of doubt within the jury's mind, muddying the waters so to speak? There were obviously no independent witnesses to the woman saying to Brand to stop anally penetrating her so is Brand as a pp suggests trying to portray the woman as sexually adventurous/uninhibited so in one awful respect anal could have been semi expected as part of a varied sexual encounter?

This is what I’ve understood it to mean.

H202too · 29/10/2026 10:21

Laura is giving evidence. 🙄

TotaleclipseinFrance · 29/10/2026 09:32

There is no way to talk about this properly without going into graphic detail.

My understanding is that he said this woman rimmed him the first time they met.
If I'm wrong, then please disregard the rest of this post.

If I am correct, however, then it seems to me to be an attempt to suggest to the jury that this woman was, to put it into very crude terms, 'up for anything.'

Also, never ever forget this woman suggests that even within his wild sexual world, this woman was particularly unusual.

This does not mean to say the woman consented to anal sex at all. Oh no.
(I can't imagine that anybody would think this would be undertaken without adequate preparation if truly consensual) just that he thought she consented.

Ah, we almost cross posted. You’re right about the rimming; the evidence came from the complainant’s friend. I understand what you’re saying about ‘up for anything’. But rimming is wildly different from being violently penetrated anally, and my point is that his ‘AP’ note on his phone could refer to the rimming, not ‘she’s indicted she’s up for anal’. So I don’t think it helps him. That whole part of his evidence did him more harm than good imo.

KidsDoBetter · 29/10/2026 10:29

Gosh - Laura Brand is taking the stand.

Laura is giving evidence. 🙄

Was she there? 🤨 Was she a witness to the anal sex, and can confirm whether consent was granted?

H202too · 29/10/2026 10:35

She says they had told each other they loved each other, but it "was difficult for him to be monogamous".

🙄🙄🙄

It's like asking your Mum to give you a reference.

SpanishFly · 29/10/2026 10:35

What on earth can Laura say that would help him? "He's never raped me"?

Exactly!

Picoloangel · 29/10/2026 10:37

It’s the “nice boy loves his Mum” evidence

Mamamia35 · 29/10/2026 10:37

@easteregg but wasn’t the evidence yesterday a way of showing she was kinky and had no boundaries? If you listen to the Crime Desk podcast he called it kinky and that’s why he had the note in his phone. Isn’t that playing to the jury - mainly men - that it was consensual because she was up for it.

However, Woman 5 was very robust about what she had and hadn’t consented to. If I’d been up for rough anal sex the last people I’d be telling were my mum and dad. Which I hope the jury remember.

Mamamia35 · 29/10/2026 10:39

Can someone explain the process after the defence concludes please?

H202too · 29/10/2026 10:43

Laura Brand says he "is caring and kind, a wonderful father to our child, and an amazing husband".

Don't they have three?

Closing arguments from both, some juror instructions and judge summing up, maybe some admin then out for deliberations:

mids2019 · 29/10/2026 10:44

Picoloangel · 29/10/2026 09:45

No one says beyond reasonable doubt any more most lawyers and judges will define this as “sure.”
The unknown in all of this is how the complainants and then Brand came across as witnesses. That may be determinative in terms of credibility. Demeanour weighs heavily in the assessment of credibility.

It's interesting the point about demeanour and personal appearance has on a jury. I wonder if anonymity helps or hinders complainants as the jury has no opportunity to see them?

The Judge will give legal direction to the jury and then there will be closing speeches from the prosecution and the defence. The Judge will then finally give a review of the evidence. The legal direction can take some time as the barristers will feed in to that process.

KidsDoBetter · 29/10/2026 10:51

They really have powered through it all - so much faster than anticipated.

I like that the judge asked Winter to move on when he was lingering over the touching start of the relationship ... 😂

SpanishFly · 29/10/2026 10:59

Laura's evidence was pointless - she's just said that he's lovely, and a wonderful father, and the first time they had sex, it was at her pace. So, yeah.

Tiredbean · 29/10/2026 11:00

Does anyone know anything about Laura’s family?

Are they supportive? Have they been in court?

I think the jury can see them. They've been granted anonymity outside court.

I dont know their current thoughts - but Kirsty def supported him/them when the allegations started

KidsDoBetter · 29/10/2026 07:49

Are you a bit hard of thinking? That’s exactly what the majority of rape and SA cases come down to.

There have been no transcripts from the court. Detailed reporting, yes. Full transcripts, no.

Are you a bit hard of manners? Or do you usually throw random insults at complete strangers on the internet?

U53rName · 29/10/2026 11:29

I don’t think I’d be able to sit through ex victims sexual partners of my DH crying about the trauma.
