26million US marriages may be invalidated.

Kim Davis, a former Kentucky clerk who infamously opposed marriage equality, is once again asking the Supreme Court to review her case and revisit Obergefell v. Hodges.

A federal judge previously ordered Davis to pay a total of $360,000 in damages and attorney fees after she refused to issue marriage licenses to two same-sex couples in 2015, which she has appealed. SCOTUS previously declined to hear her case in 2020.

Davis is represented by the Liberty Counsel, which has been designated as an anti-LGBTQ+ hate group by the Southern Poverty Law Center. 10 years after marriage equality, her lawyers are still fighting the ruling and Obergefell — the Associated Press reported in June that they hope to “affirm Davis’ constitutional rights” and overturn the case.

In Obergefell v. Hodges, the Supreme Court ruled that all states must perform and recognise same sex marriages. Prior to this ruling, 36 states already performed and recognised such marriages. It is unlikely the Supreme Court would go as far as outlawing same sex marriages completely, but it could allow a return to the previous situation where some states do not recognise such marriages.

I don't know where the idea that 26 million marriages could be invalidated came from, but the figure is clearly grossly inflated. In 2021, there were 61.3 million married couples in the USA, of which fewer than 750k were same sex marriages. I'm sure the number of same sex marriages has gone up, but not to 26 million. These marriages would only be invalidated if the Supreme Court outlawed same sex marriage completely.

It’ll go similar to the abortion ruling. States will get to decide whether they will support it or not. You can easily get married in another state, yes it will be a hassle, but they may just have to register in another state.
