Basically their argument is sending him to prison would trigger PTSD from his experiences in Syria. Now in my view its dangerous because it implies if you have a mental health condition you are free too commit dangerous acts and use it as an excuse not to go prison right or wrong ?.

I can’t read the article but I am so sick of this shit. To be fair I don’t think he should be jailed at the Uk taxpayer expense, he should just be deported back to Syria. We have an international responsibility to asylum seekers but also a responsibility to our own citizens. If you commit crimes against our citizens (I’m not talking about parking tickets) then you’ve abused the hospitality of this country and you’re not welcome any more. It is very easy not to sexually assault anyone.

His lawyer is entitled to make the argument. That doesn't mean the courts will agree. And I wouldn't rely on press reporting on this kind of thing. It often gives a distorted picture. There was a case a few years ago where it was reported that an illegal immigrant could not be deported because of his pet cat. The reality is that the Home Office had conceded that they had failed to apply their own policy for dealing with unmarried partners of people settled in the UK. The cat had nothing to do with it.

It's the Torygraph and they're a mouthpiece for Tories. They want to take the UK out of the ECHR.

Where exactly will he be deported because Syria is a mess? His lawyer has argued that imprisoning him may breach his rights but it's up to the judge to decide on an appropriate punishment.

Have we become so woke we won't even put a sex offender in prison, no wonder this country is doomed.

His barrister is doing what he is paid to do and arguing for the best outcome for his client. The judge has not yet decided, so you are jumping the gun.

No legal case can succeed unless the defendant has a lawyer making a conscientious case for their client's interests. Everyone is entitled to an effective defence, regardless of the crimes they may have committed and regardless of where they have come from.
Even if you are only interested in prosecution, an effective defence is essential. If an effective defence was missing, then any conviction or sentencing would be on shaky grounds and could be challenged.

The other day someone couldn't be deported because his ds would only eat a brand of chicken nuggets you could not get in his own country. It is madness.

Or are they planning on appealing the judgements in things like the chicken nugget example given above? Because if that's what you're after, Yvette Cooper did that already in August for that case, and a judge agreed with her.

The reasons for blocking deportation were more complex than that. Also, the upper tribunal has already overruled this decision and sent the case back to be reviewed.

You'd better raise that with the Sentencing Council. Whether an offence of sexual assault (which is what we are talking about here) carries a jail sentence depends on the seriousness of the offence. Having said that, the description I've seen of this offence means that it should carry a jail sentence under the current sentencing guidelines.
