Molly/Misbahs mother wins custody case - she must return to the UK

A Scottish girl embroiled in an international custody battle must return to her mother in Britain, a Pakistani court has ruled.

The High Court in Lahore said 12-year-old Molly Campbell, also known as Misbah Rana, must be handed to the British High Commission within the next seven days.

She will then return to live with her mother Louise Campbell in the Western Isles, Scotland.

Molly has been at the centre of a tug-of-love legal fight after running away to Pakistan to be with her father Sajad Ahmed Rana.

He said: "I was very surprised and shocked by this decision. I must speak to my solicitor to see if we can appeal.

With her mother "Misbah is very devastated, she was crying, she is very upset. She doesn't want to go back to Scotland, she wants to stay here in Pakistan.

"She did not get a chance to address the court. She doesn't want to go back to Stornoway, her mother's partner used to shout at her."

Misbah's mother had lodged a legal petition in Pakistan claiming the youngster was taken to Lahore illegally by her former husband and eldest daughter.

Mrs Campbell had been awarded interim legal custody in the UK last year, for permanent custody of her daughter.

In legal papers submitted at the Court of Session in Edinburgh on November 17, Misbah became joint defender with her father against her mother's civil action.

An international hunt was triggered three months ago after her 18-year-old sister Tahmina - who lives in Pakistan - met the youngster outside her Stornoway school and went with her to an airport

Horrid! This girl's wishes have been COMPLETELY ignored.

The mother has a history of instability and substance abuse.

If I were the girl's age and had to be stuck in a hole like Lewis, especially as a Muslim, I'd want to live in Lahore, too.

Agree - 12 yrs old is old enough, and given the cultural aspects and being a muslim Misbah wants to stay with the parent and siblings who embrace that.
Although she was taken illegally, which I think is the only reason the ruling was made perhaps?
I hope the mother sees sense and come compromise to keep Misbah happy happens asap

I think it is really disgusting and feel so sorry for the girl, as expat said, she has been completely ignored.

Why do they do that ? Completely ignore peoples wishes

sorry that sounds awful

but that was my first knee jerk reaction

obviously thinking rationally and in a calm and reasoned manner I wouldn't be quite that harsh

her mother had legal interim custody, so Misbah being a minor, her leaving had to be facilitated, wanted or not = illegal actions taken by someone
However morally wrong it was.

I have been in her position kind of. When my parents were getting divroced I was 11 and wanted to live with my dad, but I was completely ignored by the people who were meant to help me (family court people). They literally ignored me everytime I mentioned it and moved on to the next question.

At age 11 I ended up having to write to the childrens legal centre for help and eventually got my own legal representation, who helped me write to the courts and to my mums soliciter to put my point across.

Exactly Piffle, I just don't see how it is good for anyone.

Incidentally, I was advised by my soliciter that if custody went to my mum, to just ignore the ruling and keep returning to my dad.

My mum gave up the fight in the end which is something I am hugely grateful for and as hard as it may be, her mum should do the same.
