According to Kent Online. Before the government made squatting in private houses a criminal as opposed to a civil offence they were warned this would happen.

Of course people are making the assumption that he didn't break in the night he died as he didn't want to break the law on squatting.

It may not be as simple as that, under the new law if the Police arrest someone for squatting and find they are homeless and vulnerable they have to call Social Services or a charity to get the person help and support.

Now reading the article it seems the police did just that. When he was arrested, he was taken to Hospital and Social Services got involved, that is made very clear by Mr Bailey so instead of the Police just arresting him and turning him into a criminal they got him to a safe place and access to support services.

Why he was back on the streets afterwards is not clear, it maybe that he was let down by SS or it may very well be that he had his own reasons for refusing help and/or not wanting to come to the attention of the 'authorities'

And maybe thats the reason why he chose not to do anything that got him arrested, the fear of help and state interferance not of being criminalised
