This is an interesting if cryptic sentence from a Mary Riddell article a couple of weeks ago: "Even those closest to Mr Clarke are far from certain that the legal aid cuts demanded by the Chancellor will be consistent with the statutory duty to provide access to the law."

Unless the "surprise" exemptions (as the Guardian terms them) come under this heading, then it looks as if the three-month consultation period for this may be a stormy one.

2shoes - it says it's being cut for immigration where the person isn't being detained (and in most cases where it's going through the courts they're usually detained)

Not sure why everyone is surprised by this, we are stepping back to the dark days of conservative party politics during the 80's & 90's when there were lies, corruption & cover-ups by several prominent ministers including our current justice minister Kenneth Clarke. If you remember the BSE scandal you will understand what I mean.

I do hope it won't affect on going cases as what a wast of thousands of pounds of money already spent. with no hope of the guilty side paying costs/

Not acceptable to put the boot into the disabled or asylum seekers, I think.

Whinging students on the other hand who can spread their repayments out over a lifetime with easy-access loans (and not pay anything while earning under a certain amount) can FRO as far as I'm concerned. Could we at least have easy-access loans for justice and IVF? Thanks, that would be great.

(sorry, I probably shouldn't keep dragging students into it but I'm mad about this).

No Legal Aid for clinical negligence - so if you are in labour, and for example, someone very unskilled with forceps delivered your baby, and fractured their skull - and you weren't erm earning £200K pa (solicitors fees are mo-f'kin scary) - you would not get legal aid to help prosecute for negligence?? That's just one example from my close circle of friends (her DS was left brain damaged) I can think of many more. Shock Angry.

That's just RIDICULOUS.

And what about in family cases where there is no DV, no threat of abduction, but you are repeatedly taken to court by a bullying ex who can pay? (Been there got the t-shirt, without legal aid, I probably wouldn't have my DS1, or even have access) Shock

Employment too - so a low-paid worker can be sexually harrassed, sacked when they complain, or sacked while on Mat leave, and have no way of going to tribunal? Way to go there - Stuff the poor, they can be treated however badly, they can't afford to do anything about it

yes - but they're being sly with that one - most asylum seekers that are having to battle through the courts (and therefore needing legal aid) are already detained. So they won't get help.

I suppose it means they can leave babies wihtout milk for 18 hours and get away with it more often. Not to mention deny all of them refugee status without any fight

So they fuck over the women in bad (but not "violent") relationships - reduces the number of single parents I guess Hmm

They can make cuts to the NHS without fear of having to pay out when they f*ck up. And slash the NHS budget just by cutting the amount they currently pay in compensation

And they can reduce the number of benefits paid by not helping those who are entitled 6o them (But again have been fucked over) to make sure they get them.

think I will retire for the night, the thought of the disabled kids who will now not be able to get justice makes my blood boil, I do hope they have a rethink.
but hey the kids affected won't be able to protest as most of them can't talk.

Isn't the expectation that people would instead go to "no win, no fee" solicitors, so you would still be able to sue if you had a case that was deemed winnable.

I work in the criminal justice system (in witness adn victim care) and guess what, our specialist domestic violence advisors are being made redundant :(
