Presumably it didn't involve full intercourse, in which case it quite possible they didn't know she was a woman...

And it does say tricking them into sex. Surely it would be sexual assault if it was not full sex? Confused

Wasn't there a similar case in the states? The woman used a prosthetic penis in her underwear and claimed an accident/operation meant 'he' couldn't achieve an erection and gave the women oral sex, masturbation & used vibrators on them etc

It might be slightly off topic but is it really sexual assualt/ criminal to have consensual sex without full disclosure about who you are? This is like the "rape because he claimed he was Jewish and I wouldn't have slept with him otherwise," story. Can we really claim to be assaulted because someone wasn't what we thought they were - does this apply to their salary/ age/ backstory/ capacity to be a twat, or just gender and religion?

Sorry but I think that "persuading someone to consent to sexual intercourse" is not a crime or we would all be in trouble (my bedroom isn't normally as tidy, nor my legs as perfectly shaved, for example). Neither is pretending to be a man criminal, who decided the combination amounted to illegal activity?

It's an odd one isn't it Runner. On the one hand I can see that sleeping with a man weho turned out to be a woman would be a massive shock - but is it assault?
