How much compensation would you ask for?

A social worker undertakes an assessment of your families needs. The assessment is highly inaccurate, full of exaggerations and untruths and wrongly determines you are a risk to your child.

Family Services decide to take you to court and your child is placed in foster care. They fail to consider placing your child with family members. After six months of court proceedings, Family Services begin to see the original assessment was inaccurate. Your child is returned home and encourage you to make a complaint.

You complain. Spending two years fighting through paperwork and waiting for a result.

Family Services accept they were wrong. They apologise. They say sorry.

They say the assessment was inaccurate and exaggerated. Your child should have come home with support at the end of the assessment, instead we wrongly took you to court and wrongly separated you and your child for six months. We are sorry, we will make sure it does not happen again to other children by ensuring assessments are accurate!

We will compensate you for the injustice you and your child suffered.

How much money do you want?
What answer would you give?

I have a negotiation to attend next week and no idea how music to ask for?

In my professional experience I would say start off asking for £25,000 and maybe accept half that. however all depends on your specific circumstances , how old children are etc etc.

Google local authority ombudsman decisions for examples to give you a n idea.

I think £25k sounds good negotiating position - if you took it to court you wouldn't get punitive damages.

There might be something here that's useful

The parents in the Haringey case only got £2k but that was much less serious.

Find out how much family therapy will cost over next year and say you definitely want the cost of that.

Ask for £25k to be put in a fund to help others in your situation defend themselves, plus £2k for your suffering.

If possible ask the awarding authority to ensure it comes out of the bonus pool for social services.
