With the changes to home Ed proposed if my child has an EHCP will I be able to de register ?

Or will I need to have the agreement of the LA? It’s really making me consider not applying for one as we want to home educate for secondary?

You can electively home educate any child with SEN but the LA have no obligation to provide the provision which was included in section F. Essentially it's all on you.

There is something called EOTIS (education other than in school) where no school is suitable to meet a child's needs then the LA has to continue to provide Special educational provision but at home, this is very rare though.

So in short.. you can home educate whenever you want, the EHCP doesn't change that. The new proposed changes prevent children under certain social services care plans or social services investigations from being withdrawn from school.

No ,you can still deregister without permission if they are not in a special school.

Currently, if a compulsory school age pupil is in SS funded by the LA, you need permission to deregister. That isn’t quite the same as permission to EHE. And permission should not be withheld unnecessarily. Depending on if/how it comes into force, the Children's Wellbeing and Schools Bill may require home education to be in the best interests of compulsory school age pupils in SS funded by the LA first.
