Anyone been refused a Visa for USA?

Does anyone have any personal experience with what constitutes an offence of Moral torpitude?

We have a holiday booked to the USA for this summer and I am quite worried about a Visa for my DH. He recently, at almost 50, recieved a caution for shoplifting. It was a first offence and it emmerged shortly afterwards that he was suffering with severe depression.

He is now recieving treatment for this, and also has a good, stable job in the UK as well as 2 young children at school etc, so not really a risk of trying to stay in the US.

Just looking for some advice on whether he needs to declare this on the ESTA form, does a caution count? and does it involve moral torpitude?

Was he arrested and or charged?.

If he was arrested and or charged with an offence then he will need to apply for a visa from the US embassy in person.

He will certainly need to speak to the US embassy in London but in the longer term this offence should not in itself bar him from entry into the US.

presumably if he received a caution he was not charged and therefore hopefully it won't be an offence of 'moral torpitude'. With a bit of luck he won't have to declare it for the purposes of the form but await someone in the know coming along

Thanks both of you, It has just been the worst time ever and such a shock. Whilst he knows that what he did was wrong, it really was a cry for help and it makes me quite sad that it may affect future family holidays.

Hopefully the US embassy won't refuse him a visa.

They probably won't.

The UK has a similar policy in place for visitors from the US.
