Can anyone help me understand annual leave

If you are a part time worker and you work 5 days per week,
1 should you get 28 days annual leave?
2 if you book annual leave,do some companies tell you,you have to accrue the holiday first even if you have been there say more than a year?
3.if you're being told annual leave is worked out in hours, but then also being told to look at your monthly wage slip which holiday is based in £s,would you work out what you earn per day and deduct it from that?
4.if you have worked 5 months of the year so far, would it be correct to have only earned 6 days annual leave so far this year.
Asking for a friend as this has baffled me,
So if you are a part time worker or know the ins and outs
Would be very grateful for any advice or insite

Part time so I guess 5 short days?

if the full time allowance is 28 days - is that with bank holidays ?

if you have worked 5 months and you get effectively 20 days you would expect more than 6 days accrued? That would be 8

Part timers leave is usually worked out in minutes and then turned into days. Its a horrible job but there are plenty of online calculators out there. Its not a straightforward equivalent as bank holidays still apply and make the maths messy.

My friend says in her contact it says 28 days which is including the bank holidays, she works Mondays anyway but the business she works at they shut so she gets the bank holidays paid.
Is there such a thing with companies to have to accrue the holiday if she has been there more than a year?
The company said to her the annual leave is based on hours worked that particular month, but then she is being told to look at her current wage slip which she received today says holiday pay owed to date 387.65.
So I have just worked out what she earns per day and it's being worked out as 6 days holiday

Are you taking into account the bank holidays that she has already used so far this year?

When she asked for instance about the bank holiday Easter weekend it wasn't on her last wage slip as hoilday pay,she was paid the right hours, when she asked they just said No
We calculate the holidays separately from bank holidays and pay them as a normal day, hence why it wasn’t itemised separately, the only reason I'm asking questions on here,as she said they are not very helpful in helping her understand how it works, that's why I have come on her,so you think what I worked out from her current wage slip today, that the bank holidays are being taken out of the annual leave hence the 6 days I have worked out

It's about right, 28 days inclusive of bank holidays. Assuming the holiday year runs Jan-Dec, she'd be due 11.7 days by the end of May and 5 of those days would have been used up by bank holidays (1st Jan, two at Easter and two in May).

BaronessEllarawrosaurus · 29/05/2025 11:01

If her annual leave is inclusive of bank holidays then yes it is roughly correct. 28 days works out as 2.3days a month, we've had 5 bank holidays so far so 2.3 x 5 - 5 already taken leaves 6 and a bit days.

Yes she said runs from Jan 1st to December 31st,forgive me if I am not understanding this correctly,so far she hasn't booked or taken any annual leave so far this year, now that I understand that the bank holidays are being taken out of the annual leave, she thinks she wants to take maybe 2 or 3 weeks in September but if they are telling her to accrue the holiday then by September she would have enough annual leave and would be paid for some of the days off,she would want to take

Sorry I meant if she wants to take maybe a couple of weeks in September, but if they are telling her to accrue the holiday first then some of the days she would be taking, wouldn't be paid is that correct

Using bank holidays in that way would be wierd - imagine if you started at the beginning of December ? 3 or 4 BH in just over a month

PhilippaGeorgiou · 29/05/2025 11:50

In terms of accrual, technically this can only be used during the first year of employment. That is irrelevant however - there is no right to take holiday when you want to take it, so the employer can simply refuse her permission to take leave. Other than finding a better employer, her only real option is to negotiate with the employer.

Tiswa · 29/05/2025 12:20

She owes holiday pay but hasn’t taken holidays apart from bank holidays which were included and the place was shut?

ACAS have a free helpline I would contact them

But she hasn't actually booked any annual leave yet,so far this year, the holidays that have been paid so far are the bank holidays

But is that a thing where that can be done,ie like the company is doing taking the annual leave, like they are doing, like you said,if you did start In December, and they are saying you have to accrue holiday, then you wouldn't of worked enough days to earn that, let alone even be paid

Was she paid for new years day or was her pay reduced due to taking a day off without having already accrued any holiday leave? If she was paid for it then obviously she can take before accruing.
