Taking son abroad for 3 days without father's consent

Hi all

My son is 5. Me and his dad got divorced a few years ago. We have a Child Arrangement Order.

There is a line that reads "Upon the court noting that child resides with the mother at an unknown address to the father, which the father consents to"

Do I still need a permission letter from his dad to take him to Spain for 3 days? I have read that if it states on the CAO about the child living with the mother then I can take him for 28 days without permission but asking incase i'm misunderstanding

I do not have the same surname as ds. I have his Birth Certificate. Will this be sufficient?

Unfortunately after the court order (which he requested), his dad disappeared and only sees ds once a year. If I call about anything, he doesn't ring back or reply to my messages and I only hear from him if he wants to meet with DS once in a blue moon. I have asked for the permission letter and keep asking him since March but no reply/calls back

I’d just go. I don’t think you need his permission for a long weekend.

Thank you Zair. Yes I was thinking the same as it's only 3 days as opposed to 2 or 3 weeks abroad

No you do not need permission, unless it is over his days as you have the cao

The 3 days definitely don't fall on his days of contact. Phew thanks for the replies. Feeling a lot better. It did sound silly to get permission for just 3 days especially as he's not in ds life. I will take his Birth Certificate due to the surname being different
