Home fees for EU-based British citizens - help!

I cannot find any information online but I seem to remember that part of the Brexit Withdrawal Agreement included the possibility for British citizens in the EU to pay home fees (rather than impossible overseas fees) for some years after Brexit. Has anyone looked into this? DS wants to apply for Oxford but there is no point in him applying unless he can pay home fees to be honest.....

Yes, we've done it.
Iirc, if you're a BC but EU resident you can get home fee status until 2028.

Thanks! It doesn't seem to be very well publicized - I wonder why! Good to know that someone has actually managed it - was it applied automatically or did you have to push?

It was semi-automatic , when DD first started looking there was this grey area still that the post Brexit legislation hadn't covered.
Then just as applications for the first totally post Brexit intake started, they added a clause to the Who is Eligible for Home Fees thing.
I did write to the universities she was applying to to confirm- which they did, and then when her UCAS form went in, and she ticked "home student" it went through automatically.
It should be smoother now that it's been up and running for a year!

Yes, as long as you moved to the EU before the end of 2020.

Bear in mind that this is a temporary state in which certain groups have protected rights under the EU exit agreement (they apply to some EU nationals living in the UK, too). The general point of home fees is that they apply to people who are settled in the UK; citizenship isn't really relevant. Home fees are supposed to apply to students whose families are UK-resident for tax purposes. There's no reason why British citizens living with their family in another country where their parents pay no UK tax should be eligible for home fees. Obviously, anything to do with tax status quickly becomes very complicated...

Frankly, I don't give a damn. I wasn't even given a vote in the referendum that took my rights away. I think this is the very least they can do and doesn't even come close to the damage caused to my family.

You need to make sure he would both be assessed as a home student by his universities, and by student finance. The assessments are separate

No, but relatively few individuals that apply will fall into this category, so be prepared to be assessed as international, and then to ask them to reconsider based on the exit agreement - and to provide the link!

I was slightly concerned when DD started with her UCAS application this time last year- and emailed the application offices of most of her choices, clarifying she'd be considered as a home student under the legislation. All replied that she would, and both at the UCAS stage and the Student Finance stage, her home status has been applied automatically.
I agree that there won't be that many applying under the clause, - in the various chat groups DD is in, she's met a handful only.
