I think you're going to need to give a bit more info if you want a response OP.

That's rather an inflammatory title combined with nothing more than a link. I'm not clicking on it, that's for sure.

It is similar to the Charlie Gard case but the women has capacity .Two psychiatric experts have said she is not is not suffering from any mental health illness. She can speak and the NH wants to stop dialysis and let her die. She wants to go abroad for treatment. They have "gagged" the family so they can not give any interviews or start a go fund me. I agree with OP unbelievable

I’ve read the link and tend to agree with the OP.
That said, this case undoubtedly raises complex ethical issues, which must surely have been considered by wiser people than me but it doesn’t seem quite right that doctors can ride rough shod over the wishes of a patient who is of sound mind (for want of a better expression) and wants to try every avenue to prolong their life.
Who knows what a ruling in their favour could mean for the rest of us who god forbid might find ourself in a situation where experimental treatment is the only option available

@patchysmum

She does not have Capacity. The fact she is a legal adult, conscious, and free of mental impairment does not equate to having Capacity.

Justice Roberts' judgement makes this clear. She absolutely refuses to accept her diagnosis despite multiple sources being in agreement, so she can not claim to be making informed decisions about her own care.

She does not acknowledge that even attempting to travel to Canada, irrespective of whether treatment is available or not, will inevitably kill her before she even gets there, which is in itself proof that she is not making rational decisions and therefore can not be deemed to have Capacity.

I read she does accept her diagnosis and can you blame her at 19 years old hanging on to the hope that she could travel to Canada. I still think they should not withdraw treatment when she wants it to continue.

There is a whole other thread in Chat about this which gives lots of good explanations.

She doesn't have full capacity. There is no treatment available for her abroad. The family hasn't been gagged, this is a Court of Protection case in which the norm is for patient confidentiality to be kept.

Maybe if you checked the facts you wouldn't find it so unbelievable.

Is this the 18 year who wants to go on the experimental trial in the USA which isn’t running, even if it was they haven’t said they would except her and she is too unwell to travel too?

Oh well if you read it somewhere it must be true.

Better let the judge know then.
