My DD is nearly 29 and is a full time wheelchair user with cerebral palsy although she is severely physically disabled she has capacity and is able to make her needs known, sadly over the last 2.5 years she has been in daily chronic pain which has effected her mental health and has made her grumpy,depressed and quite frankly her quality of life is poor. She is living independently with a live in Carer and 4 pop in carers to assist with her personal care. The Gp are unable to give her strong pain meds because they leave her constipated and feeling really sick. She now has crushing headaches and loses feeling in her limbs on a regular basis, she cannot now drive her electric wheelchair far without assistance. During one of her many visits by paramedics one kindly ambulance assistant saw the position we were in and confidentially recommended CBD oil (cannabis oil) for my daughters pain etc.. After much research I ordered some which is uk sourced and supplied in Covent Garden it's filtered to take out the highs and lows ingredient and within a day it came through. Before going to the local shopping centre I placed only 2 drops under her tongue.....within an hour she started crying when I asked why she said it's been so long since I've been in such low level pain, when I asked for her pain count she said 6 out of 50! I was amazed her mood lifted and she drove her wheelchair for the first time on her own again. She slept better that night and her anxiety levels were really low. Next day I gave her more drops in morning and then at night and was amazed once again by the positive results. Holland and Barrett sell it but in a much lesser strength. I rang her care agency who stated categorically that their carers would not administer without a gps letter (fair enough) then they said if she keeps it in her apartment,if their carers see me administer they will 'get in touch with the relevant authorities' her Gp has flatly refused to write a letter and I don't know which way to turn it is legal in the form of an oil in the uk and although you could argue there may be side effects she has already had really bad side effects to the gps meds. I'm giving these oil drops to my DD in secret because I don't want her to be in this awful pain everyday. Where can I get help?

Don't swap meds it's not fair on anyone. Just fight this with reasonable questions about rights and you will get there.

She is due to see consultant next Monday...he's been on annual leave and is back tomorrow I'll ring after my night shift tomorrow morning to see if he'll see me tomorrow please wish me luck I'll put all my reasons for giving to him and hope and pray he'll write that letter of authorisation.

The NHS have been testing CBD oil recently so hopefully it will eventually become available on prescription. Plus it shows its being taken seriously now.

Could you mention this to GP? It's so frustrating when it's more than likely less harmful than her prescribed medication and more effective at that. I believe marijuana serves a huge purpose in the same league Penicillin does. I just wish this country would catch up.

Sorry to come back to this again, but just thinking about your daughter's situation from a legal and consent point of view, you say she has capacity, well I would suggest getting some legal advice because...
Under the Mental Capacity Act 2005 everyone is assumed to have capacity to make their own decisions unless a capacity assessment is carried out by a professional which says that the individual does not have capacity to make a decision about the issue concerned. You say your daughter has capacity to make her own decisions, therefore she can make the decision to take CBD oil and the carers should not stop her. They may not agree to facilitate the administering of the CBD oil but if your daughter makes her wishes known that she wants you to administer the oil to her twice daily (or whatever) in writing then they legally have to go along with this request.
If they do not and you are prevented from administering it or from seeing your daughter twice daily or as much as she wants, then I think this could be challenged under laws around Deprivation of Liberty Safeguards which are contained in the Mental Capacity Act.
This is assuming that the CBD oil is legal and there is no chance of oil which contains THC being used, which is at this time not legal.

I'm not a legal expert, I work in mental health but have had some recent training around mental capacity and deprivation of liberty, and can see how it may apply in this situation.

Also who wrote the letter added to her care plan which states 'do not give her oil'? Even if this was written by a social worker and there is a threat of 'going to safeguarding' as long as CBD oil is deemed to be legal and your daughter is expressing her wish to use it, and there is no concrete evidence that it is going to be harmful for her, I cannot see any legal case how they can stop it.
I suspect they have the belief that it is some kind of illegal cannabis oil that you want to use instead of CBD oil.
