Neighbour over the back has just knocked and told dh she has applied for permanent to chop back our protected tree. The man hired is coming on Fri..
Would a discussion about this have been The Done Thing first?
I will be checking with the council tomorrow as we have been burned before my ndn smashing down the wall that belongs to our property (rented but you know what I mean!)..
Feel a bit narked she never bothered discussing it first!

Does the tree have a TPO on it? If so, it is unlikely they will get permission to do anything to it at all unless it is diseased/dying or likely to fall and damage property. Speak to the council asap.

In any case it is on your property so you do not have to allow access to some lunatic with a chainsaw if you don't want to. Have you informed your landlord?

It takes at least 6 weeks to get permission, and even then the permission letter makes it clear you also have to get permission from the tree owner.

Apparently she has permission as it has an order on it... She didn't show dh anything..

Call the council Tree Warden to check it is correct and what process ndn should follow to notify you.

There is no permission been applied for!!
Seems cfery has no age limits!
Landlord def wouldn't deal with anything and letters would come to my address.. As is usual!

The council website would show the actual application (if one exists) to cut a TPO tree and the decision of what has been granted.
Have a search but also call the council and speak to the right team.
Whoever owns the tree is responsible for ensuing fines. Landlord would not want this.
Do not allow anyone on the property or anyone to touch the tree without the landlord's permission and without seeing documents showing any permission has been granted by the council
Even then, you'd need to watch they don't get carried away and cut more than what was allowed.

if the guy turns up tomorrow, will you be around to go tell him that the tree is protected and there is no permission to cut it back? He will not go near it if he hasn’t seen that permission, not if he has any sense, as it is an offence to cut it back. If he starts work, tell him you have taken a photo of his vehicle and you will take a video of him doing the work and you will be submitting it to the council to take proceedings against him.

Will be taking pics tonight of the tree as it is. My dh is very tall so could get him to hang a notice to keep off or contact me on! The tree is down the side behind am 8 ft wall but will keep an eye out. Assume ddogs would here anyone hanging over!
Can't believe she actually lied to dh's face! Thought it odd she hasn't mentioned it. Have only spoken to her once in 7 years as we never see her. Awaiting planning man's call...
As if a call from the Council back will be today!

He will care if he has to pay a fine for unauthorised work on a tree with TPO.

Keep an eye out for any workman who arrives to chop back any part of the tree (I hesitate to say "tree surgeon" because no tree surgeon worth his or her salt would touch a tree unless they knew that there was permission to do so).

Tell them that they could also get fined for damaging a tree with a TPO. And that you would also sue them for damaging the tree.

There is 1 branch touching her house. None others overhang.. The tree is high but in my side.

Attach a notice around the tree first thing stating it has a tpo and any work will be illegal.

Have you got in touch with the tree officer to inform them? And did you do as was suggested: put a note on the tree saying there was no permission and/or keep an eye out on who did the work?

If it is your tree, it could be you that gets fined if there's no evidence of who did the work Shock

Took pics of him up the ladder. Reaching right into my garden! Stopped him cutting ndn the other way as council didn't give any permission for that. He even came in for the branches even though he should have offered them back. They had a machine to cut up the branches so he knew it was never just the 1 branch he got permission for. Not TPO permission just a nod to the 1 branch hitting her window.. Recorded them mocking I was just a tenant and shame they couldn't get the rest but that I was there!

This makes me so angry. Trees are a natural air conditioning. We are all frying now because of global deforestation.

Well it was a first being verbally abused in my own garden. Albeit rented!!
Planning man rang and is now bricking it the vandal man was overzealous....
Neighbour had no issue shouting in front of her small dgc which added to my disgust tbh. Wonder if she would have without 2 men beside her?
I have an amazing video of birds loudly chirruping in that tree. Once posted the pic on here.. A real shame.
Ironically if it becomes a neighbour dispute it will backfire on her if she sells up...
