Plant sale for fundraising - are we allowed to?

This is a long shot, but I can’t find the information online, although I’m pretty sure I read about it somewhere!

I was thinking about suggesting to the PTA to do a plant sale to raise some money, but I can’t remember if we would be allowed to it, from seeds bought in shops, due to«copyright» of the plant. And the last thing we need is any legal issues!

So my question is, are we allowed to do it? Or do we need to source specific seeds, and if so, do you know which companies to contact?

I think I’ll have to move overseas if this turns out to be ‘a thing’. Permission to sell plants, grown by yourselves, to raise funds for the PTA needing some kind of permission?!

I think it's fine if you buy the seeds.

I've seen a few plants for sale that were exclusive to a specific garden centre brand that said you are not allowed to keep the seeds and grow more of the plant to sell in the following years but that's a different issue.

Yes, that’s the ‘rule’ I was thinking about @viccat, but I couldn’t remember if it included the sale of the actual ‘first’ plant too.

IncrediblySadToo I’ve learned a lot about licences etc that the PTA needs to operate simple fundraisers this year, so I want to make sure. I don’t want any issues to bite back later!

If they are selling the seeds and you grow the plants and then sell them, then that's fine.

If you buy a plant and take cuttings or seeds from that you might have issues - some newer varieties have plant breeders rights which prohibit other people from propagating them.

You’ll be absolutely fine with seeds and any plants you aren’t allowed to propergate from should say so on the label.
