just wondering if anyone can give some advice.

had fostering viability report for my nieces baby - negative.

lots of errors so sent amendments in as directed by judge.

just received their response - still negative.

they claim that as I have an adult child and 2 younger children with Autistic spectrum disorder that my caring commitments are too much.

are they allowed to refuse me based on children's disabilities?

the first report was so wrong that the guardian was concerned for my children's safety and wanted LA to assess us !

yet after my amendments and contact with other agencies, the LA have agreed that there are no concerns and never have been with any of my children !!

any help would be greatly appreciated

I suspect it's just that they feel you've already got your hands full with two DC with ASD already. Ideally, you'd be able to give your undivided attention to this DC.

thanks Juneau, I understand that. The younger 2 are both high functioning and we also have my parents living with us so 4 adults to share the children's needs. Just feeling very frustrated

Would contact these for advice and support www.frg.org.uk have a legal Dep too.

no - they can't say that just because you have two other children with high needs you cannot cope with this child, but they do have to take all of the childrens' needs into account. It should be based on specific facts and circumstances and also the sustainability of any arrangements - they're looking for the best outcome for ALL of the children involved - that includes your own (as it should). They'll be looking for commitment and sustainability from all the adults. You could try getting in touch with CAFCASS (here - www.cafcass.gov.uk/) whose job it is to act on behalf of the children, to see what advice they can give.
