In the bashed tins bin in Safeway today there was some reduced price formula, down from about £7 to £4. It wasn't follow on, it said "from birth onwards" or some such thing.
I know this is illegal. I didn't say anything as I thought that would be a bit nebby and I wouldn't like to stop someone getting a couple of quid off it if they were buying it anyway but then again I would not want the store manager to get into trouble.
What do you think?

I would tell them but that's me. (Currently pursuing a local chemist with similar situation).
If they don't do anything about it (ie remove from display) tell local trading standards. You'll quite likely find the store manager doesn't know it's illegal and it's not unheard of for trading standards not to know. If you do decide to pursue and need the relevant bit of legislation to quote, please post again and I will find it for you.

thanks jude. Do you know what is the thinking behind the legislation? is it to stop formula feeding being a more attractive option? I can't quite understand it myself.

I think the theory is the new mum will be more attracted to it at a lower price; will not get a realistic idea of how much it will cost in the long run; plus most discounted items would have an advert/display of some sort which is also illegal.

The bit of legislation is:
Statutory Instrument 1995 No. 77
The Infant Formula and Follow-on Formula Regulations 1995

Restrictions on promotion of infant formulae
19. No person shall at any place where any infant formula is sold by retail?
(a) advertise any infant formula;
(b) make any special display of an infant formula designed to promote sales;
(c) give away?
(i) any infant formula as a free sample; or
(ii) any coupon which may be used to purchase an infant formula at a discount;
(d) promote the sale of an infant formula by means of premiums, special sales, loss- leaders or tie-in sales; or
(e) undertake any other promotional activity to induce the sale of an infant formula.

I have just had the same situation in my local Asda. I brought it to their attention but it is still there so I am writing to Trading Standards and babymilk action.

I phones Trading Standards and they didn't seem to know the law (?) so it is useful to go armed with the info Jude has posted.

I formula fed but Jude is right, the law is there for a reason and places shouldn't be allowed to get away with this.

I complained about my nearest Asda selling reduced price formula last year and got Trading Standards and Baby Milk Action involved. Asda removed the reduced price within a couple of days and someone (can't recall if it was TS or Asda themselves) called to say that it was an error by inexperienced marketing staff. So, it's worth having a moan!

Just been to my local ASDA where they are selling discounted cartons of formula (not Follow-On), the cartons are bashed. I knew there was something about this on Mumsnet and I am now going to complain. Not that I am against anyone who has decided to formula feed getting a bargain but this is clearly not right and could be enough to sway a b/feeding mum who is having problems or someone who is thinking about b/feeding changing their mind. I was going to complain to Customer Services but thought that they wouldn't quite understand. Anyway, I gather from this thread that I should notify Trading Standards, Baby Milk in Action and ASDA, going to be a busy night!
