Hi all, am asking for a friend (genuinely).

Elderly person with dementia, no POA. Estranged son.
Currently a private tenant. Landlord needs to sell the property.
Tenant has no social care in place - is being supported with a high level of care from a relative who needs to move out and can't provide care any longer.
No SS involvement to date. No care package. No savings.

The safest outcome for the tenant would appear to be a SS care assessment, and either sheltered accommodation with regular carers or possibly a care home.

But the tenant cannot understand the legal situation.

With no POA in place, who is responsible for advocating for/looking out for the best interests of the tenant? Or do SS just work on her behalf on a best interests basis?

I’m assuming no
other family? Who is next of kin? In any case a social worker needs to be assigned so I’d contact them on your friends behalf as he won’t have capacity to do it himself. He or she will advocate.

This. And I’d emphasise that the person is vulnerable and at risk, which are apparently the buzzwords to use with SS, when you need them to act PDQ.

The relative who has been caring needs to contactadult social services ASAP, who has been managing their finances so far, without poa then either ss or maybe the caring relative need to apply for deputyship. The tenant needs a capacity assessment and a GP visit. How is the rent being paid at the moment,
