My DM has been assessed as needing carers three times a day
After six weeks as far as I was aware she had to start paying as she was over the saving thresholds. My DB has decided that she needs to reduce her savings and gone with her to pay off her mortgage. Will this be classed as deprevation of assets. The mortgage was in her name. I'm so annoyed with my brother

if you pay off a debt that is not immediately due, this must not be considered as deprivation

A mortgage is a debt, so maybe not? Also the house is still hers, so she hasn’t got rid of an asset. Hopefully someone knowledgeable will come along with a definite answer.

Does she get attendance allowance now she needs care?

It’s all very well reducing her savings so she gets funded care, but certainly round here private carers are considerably more available and reliable than funded ones.

That said, she had a mortgage? How old is she?

He does realise that the Council will just put a charge against her house if she has no liquid assets right? The charge is interest bearing too IIRC. All he's done is reduce the choice that self funding care can provide. Who has PoA?

My DB has POA as he is the eldest
She is 81

All he's done is reduce the choice that self funding care can provide While she’s still living in her home, the house isn’t included in the assessment, so there wont be a charge against it.
