Attendance allowance on death

Hi all, I have tried to google but am still unclear so any help welcome.

My DM died 10 days ago and my DF is in receipt of attendance allowance but that is his only benefit. I have done the 'tell us once' form but am a bit unclear if this allowance is covered by the form as it is for DF and not DM but is associated with DM does anyone know if it stops?

Sorry if I am being dim but I really don't want to have to spend days on the phone to the DWP if I don't have to be!

Is the Attendance Allowance in his name or your Mums?

Sorry for your loss

KnittingNeedles · 11/04/2023 07:50

I'm sorry to hear about your loss. We are going through the same thing with my mum - dad died about 3 weeks ago. Attendance allowance is covered by Tell Us Once because although it is paid to your dad, it is linked to your mum. So is things like blue badges.

Realist2022 · 11/04/2023 08:43

Brilliant, thank you. I thought it was but it wasn't totally clear and I forgot to ask the registrar when I registered her death.

I keep on meaning to shred the blue badge ....

Attendance allowance is for the person receiving it due to their health needs.

There is also carers allowance that someone can claim for caring for someone with AA in place.

Sorry, I don’t understand this at all. Why is it linked to someone who isn’t receiving it?

Knotaknitter · 11/04/2023 08:51

I'm sorry for your loss, you have so much to deal with right now. As others have said, it's covered by the Tell us Once service, if it was your mother in receipt of the allowance you still don't need to ring anyone, they will already know if you used Tell us Once.

I'm reading it that the name on the form was your father's, his needs are unchanged so he still gets the allowance. It's awarded for his needs, not for your mother's meeting them. He can use the cash to put towards the services he needs.

KnittingNeedles · 11/04/2023 08:53

It's like a carer's thing. Person A has a medical condition like dementia so is the one who qualifies for the benefit. Person B receives the benefit into their account as the carer for Person A. The system "links" the two people on the claim - Mrs Jane Doe is receiving attendance allowance for Mr John Doe.

KnittingNeedles · 11/04/2023 08:54

Unless I have totally misunderstood the OP and it's the other way around.

Clymene · 11/04/2023 08:54

Yes Tell Us Once covers it. Your dad may (probably will) have to repay overpaid allowance.

I'm so sorry about the loss of your mum Flowers

CornishTiger · 11/04/2023 09:01

@KnittingNeedles yes you are totally misunderstanding it. AA is for the health needs. The claimant is the person whose health needs it relates for. When that person dies AA ends.

Another person may receive it if they are an appointee or have POA. It’s received on behalf of that person still though. It could also have been paid into another persons bank account of that was the account nominated on the claim.

Carers allowance is separate and any carer should also notify carers allowance of a death of someone receiving AA. There will be a run on. I can’t remember if the Tell us once service asks if there is anyone receiving CA for this person.

KnittingNeedles · 11/04/2023 09:02

So why does the OP say that it is "associated with DM" when the DM is the one who has died, and the DF is receiving the beneft?

Confused now!

Quitelikeacatslife · 11/04/2023 09:03

If he gets attendance allowance that is for him and he will continue to get it, it is the benefit paid to over 75s if they have health needs, the older equivalent of PIP , it is not linked to caring for your mum (that is carers allowance which will stop)

caringcarer · 11/04/2023 09:05

I think you are supposed to send blue badge back to council. Don't shred it. That's what I was told when my Mum died as a blue badge holder.

EmmaEmerald · 11/04/2023 09:05

I'm confused too
OP I am sorry for your loss

I know you don't want to spend time on the phone
but the AA query line are helpful and quick to answer IME

give that a try maybe? 0800 731 0122

itsmeagainagain · 11/04/2023 09:10

Attendance allowance is paid to the person who needs it to spend on care as needed whether that by a relative or something else. It won’t stop on the death of your mother as it’s your fathers claim. I’m very sorry for your loss x

Realist2022 · 11/04/2023 13:28

Apologies, I think he must have been in receipt of her attendance allowance - she had advanced dementia and so he would have done the claim. So when he is talking about 'me' getting it, that is because he would have done the claim on her behalf. It is the only benefit 'they' were entitled to as it isn't means tested.

In which case my question was irrelevant as I have done 'tell us once' and as it was linked to her it will stop when the DWP are informed.

Thanks all and sorry for the confusion!

Please don’t apologise @Realist2022

So would have been Attendance allowance for your Mum and possibly Carers allowance for your Dad.

Good luck sorting it all and sorry for your loss.

Babyroobs · 11/04/2023 13:33

If it is just your dad that receives AA then this will continue as normal as nothing to do with your mum., unless as others have said she was an appointee or something for his finances. using the tell us once service will stop your dm's state pension. If they received pension credit then if your dm was the main/ lead applicant then this would also stop and if your dad was still eligible then he would need to make a new claim. His state pension should be automatically re-assessed now dm had died.
Do not shred the blue badge,it should be returned to the council from which it was issued.

RuthTopp · 11/04/2023 13:33

Any benefit paid to a person who is caring / looking after the person who has the need of the help stops when the person dies.
You say you have done the tell us - so it should work. If payment continues until they process it repayment back may be required in some cases.

Just read your update. If AA was in her name yes it would stop automatically after you use the tell us once service.

rwalker · 11/04/2023 13:36

We got a bill for overpayment about a month later
that tell once service was brilliant

KnittingNeedles · 11/04/2023 14:15

Tell us Once is a great idea. I filled the form in on a Friday (mum doesn't "do" online) and by the Monday she had a letter from the Council will her new council tax assessment.

Mum worried a lot about the little things when Dad died - things that we knew wouldn't be a problem at all, like transferring Premium Bonds from his name to hers. It was even easier in our case as Dad had a public sector pension, which was also covered by Tell Us Once.

Didn’t know you could set it up like that. My father gets AA. Paid into his account. I as his attorney have access to his account.

MereDintofPandiculation · 11/04/2023 20:53

And it was I who put in the claim.
