Elderly parents

PoA documentation (paper based)

My parents organised their financial power of attorney a few years back, I wasn’t involved apart from signing as one of the prospective attorneys, this was before the system went online. They are saying they can’t now find the official documents needed for the financial PoA, they think they need to find the original signed forms. But I’m assuming these were sent to the Guardians Office? So can anyone describe what the ‘official’ finance PoA documents look like that are needed to enact it? (I can’t get to see them, too far away). The PoAs aren’t ‘live’ yet, but they were registered.

I’m a nurse and whilst I can’t answer specifically, I work on an elderly ward and if we can’t find them, we contact social services who usually have a system with a copy like a database so that could be an option?

It’s a wadge of 15-25 A4 sheets looking like a typical government form with, in large letters across the top, “Lasting Power of Attorney…”, or, if even older (before about 2010) “Enduring Power of Attorney”.

If LPA, it has hopefully been registered and will have the Office of Public Guardian stamp at top right, and the OPG seal - a circular design of raised lumps - at the bottom right.

If they got it drawn up by a solicitor, the solicitor should have a copy (although they do weed their records at intervals). The OPG may have a copy, though i’m very uncertain they’d have enough space to store everyone’s forms.

Social services ask for a copy if they are providing care services, but won’t have it otherwise. And this may only be the Health and Welfare one not the Finance one.

But I’m assuming these were sent to the Guardians Office? To clarify, after registration, the OFG return a form with the official stamp as described above. The “seal” is on every page. I can’t remember whether it’s the original or a copy, just going into a meeting, no time to look

Thanks very much - so we’re looking for a copy that has the seal / stamps on it, great. It was drawn up by a solicitor so they may well have it, I assumed they would just hand over the documentation like they did with the wills but it’s worth a check. Thank you!

Our solicitor gave us the “original” with embossed “seal” and a certified copy. Ive also just asked for another certified copy and he hasn’t yet come back with “Im sorry we weed documents after 7 years”.

If a solicitor dealt with it, they'll know the answer.

I posted this on the Cockroach thread so apologies if you have already read it.

My DF had LPAs set up by my narc sister. She lives abroad, I live 230 miles from DF. DF spoke to an estate planner who recommended updating them (redoing them) especially as my own DDs are now adults who are being added as replacements. I had no information about them other than the letters stating that I had been added as an attorney. I rang the OPG and with DF's full name, address and DoB, I was able to get the reference numbers and get certified copies for £35 each. It took around a fortnight for the copies to arrive. I presume the originals are in DF's flat but as he was staying with me for 5 months, it was simpler to get the copies sent here.

Thank you Malbecfan, good to know we should be able to get replacements if needed. No sign of them so far…
