Lasting Power of Attorney

My mum is seriously ill in hospital and I need to sort bank stuff out for her. She registered myself and my sister for LPA for property and finance in 2012.

I have a notice of registration and a letter from a consultant confirming she lacks capacity but the bank seemed to think I needed a certificate?

Can't get through to the office for public guardian! Very stressful. Thanks

A certificate? Did they mean the certified hard copy of the POA?

You need to show (but NOT give) the bank the actual poa forms, stamped by the office of the public guardian or give them a certified copy of these originals. A solicitor will copy and certify for you.

All I have is this notice of registration? Was I meant to do something with it? It just has our names on.

It says 'this is a notice to confirm registration of lasting power of attorney' and has a case number.

It might be that the forms haven't come back to you yet? how long since you sent them off?

Is this for Scotland or England?

Hi I work in bank and do register POAs. All you need sixteen pages original document or its certified copy. If you have only registration document, its worth checking with solicitor if you used to register to POA. They might have original POA document. If your mother lacks mental capacity, you dont have to prove it , Just tell the bank and they normally block donor s accounts and access so that you can take fully control of the accounts

My mum registered us in 2012 in England. I didn't really pay much attention at the time. All I received was a letter which I could object to and then this notice of registration. Would a certified copy be sent to my mum as the donor?

Yes - your Mum would have been sent the actual POA document that is several pages long and each page is officially stamped. It's probably stored in her house somewhere. Unless she did it through a solicitor then it may be stored with them.

SquirrelsHide · 14/06/2022 19:51

Posted too quick - the document is lengthy because it's basically the form that was filled in originally to register the POA - but with the official stamp added on each page to show it's been checked and registered.

My parents received the certified copies, and the solicitor they used held the originals. In my panic when I suddenly needed to use it I turned my house upside down as at the time I hadn't paid enough attention

Thank you for your help everyone. I'll have a look through my mum's files.
