Would this be allowed for top up payments?

My mum qualifies for LA funding for a nursing place.
Her property will not be taken into account as it is co-owned with a relative over 60 who lives in the house.
We are yet to establish what the 3rd party top up would be for our chosen care home.
Will it be legal to fund that top up from renting a room in the property? (It would be my mum's room but I guess that's neither here nor there)

Creative thinking! I like it 😁Have no clue as to legalities but maybe Age UK or Citizens Advice can help?

I would think at least half the rent would be deemed to be her income and included in the financial assessment and together with her pension would reduce the contribution the local authority make to the nursing home

It would be classed as income I'm afraid and therefore the LA will take it into consideration when calculating your mum's contribution.

If you tell them about it that is.

The relative could do it in their bar and pay the top up.

You at not need it if they LA find you a banding bed in place you are happy with.
