Overcharged nursing home fees due to delay in continuing health care assessment

Hi hope someone can offer some advice on my DFs situation.

DF had severe Parkinson's and dementia. After a spell in hospital over Xmas after a fall he was admitted to a nursing home for an assessment period of two weeks. However due to delays on the part of local adult services he only had his CHC assessment by the district nurse a couple of weeks ago. He was assessed as not qualifying for full CHC funding but qualifies for the weekly contrib to nursing care costs about £115 a week I think.

We have now received the bill for the nursing home from the council for the whole period he has been resident. The first two weeks are free as official assessment period but after that have been charged full rate for all weeks before the actual assessment with only the last two weeks bill being reduced by the nursing care contrib.

This means that due to the delay in the assessment he has lost out on approx 10 weeks of the nursing care contrib so about £1150 in total!

Can I appeal against being overcharged this amount due to the delays caused by the council or does dad just have to suck it up? Hmm
