Hi all my daughter has just moved from dla to pip is on hrc and lrm she is 16,she had been getting homeschooled she has refused to do her gcses due to not being able to leave the house without me,not being able to speak to a stranger,not being able to go into a school setting again ect ..is there anyway she can do them at a layer date like next year or any help I could get where I could be around for them withnher i am also her appointee..she won't be able to go to college or work anytime soon if ever ,my uc claim ends for her in August, but if she is doing an online tutoring and studying for her gcses will she still be able to stay on my claim thankyou

Have you applied for an EHCP? Has she been referred to CAMHS? She can have education from the LA even if she can't leave the house, but also, don't assume it can't get better. DD3 (now 17) spent a year in her bedroom. A specialist school spent nearly a whole academic year working their way up the driveway, to the front door, then into the porch, then the lounge. They spent hours playing Scrabble in the pouring rain at a table outside our front door. She's now full time in school.

PIP isn’t related to GCSEs.

If DD is being EHE, she can sit GCSEs (or IGCSEs. For some subjects, most EHE DC sit IGCSEs because for some subjects they are easier to arrange due to NEAs) whenever she/you like, but you will be responsible for finding and paying for an exam centre. You won’t be able to be present during the exams. Home invigilation is possible, but can be difficult to arrange.

If DD isn’t EHE but the LA is actually making provision at home, is that via s19 provision or via an EHCP with EOTAS/EOTIS? The LA’s 19 duty only applies to compulsory school aged pupils. While the LA has the power to make provision for post 16 DC unable to attend school/college, they don’t have the same duty under section 19 of the Education Act 1996. EHCP provision still applies and post 16 pupils can still have EOTAS/EOTIS/C via an EHCP. With EOTAS/EOTIS via an EHCP, the LA retains responsibility. GCSEs can be sat at a later date. You still won’t be able to be present during the exams, though.

If DD continues to be EHE, she can remain on your UC claim. She doesn’t have to be working towards qualifications for that or studying via a formal provider (online or otherwise).

Alternatively, you could look at making a claim for DD in her own name.
