school appeal

hi my child has been permanently excluded the school issued a suspension then straight after a permanent one for the same thing
no new evidence was found
is this a conversion and what can i do about it

Have you been invited to an exclusion meeting with governors?
Do you intend to appeal the exclusion?
Has the school provided work for your child in the interim?

You will be invited to a meeting with governors, head and normally a representative from the local authority. You are allowed to query what you've said. If the GDC meeting finds that the permanent exclusion is justified, proportionate and fair, then you'll receive a letter which states that the governors have declined to reinstate. The letter will give you details of how to appeal this decision, which involves another meeting called an Independent Review Committee which has to be chaired by an independent panel of governors and an chaired by a headteacher from a different school
If at the first meeting, the school are found to have not followed the permanent exclusion process properly (as you're saying they've issued a permanent exclusion on the back of a suspension) then you'd receive a letter stating that the permanent exclusion needed to be 'rescinded' and arrangements made for your child to return to that particular school.
Your child will remain in alternative provision whilst the different meetings take place.

If you have evidence that they have issued a permanent exclusion for the same thing as the suspension with no new evidence and the local authority representative agrees with you, then you may find that the school withdraw the permanent exclusion and the school may suggest a 'fresh start' at another school via a managed move. That's up to you whether you agree with it or not or whether you wish to try and get it quashed at the meeting.

The other alternative is to make an in year admission application for a different school.

Academies can refuse to invite the local authority representative unless they are specifically invited by the parent.

No, if you mean can the school reinstate or decline without the meeting? They can look for an 'alternative to permanent exclusion' and decide to withdraw the permanent exclusion completely, but that normally gets identified before the 6th day and alternative provision kicking in and have to say that its normally when a young person has done something 'wrong' as a one of incident of they're in Year 11. What has the school and the local authority representative said to you so far?

she has done something wrong it was a one off and she is in year11 the appeal meeting is soon i just assumed they would wither reinstate or decline
but with the argument that the headteacher issued a suspension then permanent exclusion without further evidence coming to light would this be strong enough for the appeal and could she be reinstated @Lightuptheroom

You shouldn't need to go to appeal of the governors meeting decides that the headteacher hasn't applied the permanent exclusion correctly. They would inform you by letter after the meeting that the permanent exclusion has been rescinded. Have you read the pack which contains the schools statement, that will tell you what they are presenting as their evidence . Have you had contact with someone from the local authority as they can explain how the meeting will run to you.

Sorry, I'm confusing you. The first meeting isn't called an 'appeal' but yes you are correct that you are 'appealing' against the PEX

The local authority will challenge the school if what you are saying is correct (no further evidence which led to PEx). Ours send a report to the panel. The governing board should not agree the PEx if this is the case as it is very likely a later appeal would go in your favour. Have you had the PEx pack? Are you sure there is no new evidence sited? In the PEx pack, there should be a detail of someone from the local authority (maybe the person who organised the provision). Have you spoken to them about the evidence concern? It’s worth raising this now as once the panel begins, that process can’t be stopped. If the school realise they’ve made an effort now, they may rescind.
