Any union reps out there?

Hi,

I have been signed off with WRS and due to return on 4th Nov. Whilst off I have resigned to leave Dec 31st. My role has been advertised and interviews will shortly take place. It doesn't state a start date, but can the school start someone in the role before my notice period?

Yes. If they have the money. They might be desperate. It’s expensive though. An employer can have two people doing the same job if they wish. You should receive the money for your job whilst on your notice period. However, why do you think someone will start before you leave? They might try and get someone for the job before any cut off for their resignation to take effect. Thats fairly normal. It’s also normal to recruit as they have accepted your resignation.

I imagine they would seek to factor in a transition period if the chosen candidate is able to start earlier. They may also feel that it is possible you may extend your sick note as this is quite common in these situations where someone is currently off sick and leaving soon. Remember that the headteacher can direct staff as they please to suitable roles in school. Have you been with your current class/classes since the start of term? Will you be having a phased return?

Not union, but a HR guy here. The straight answer to what you've said is 'yes, they can', as the others above have posted, it's a totally legitimate way of replacing someone if they are leaving, in any profession, even if person is off sick. Especially given you say that you resigned?

However, there is some nuance to your enquiry - is there a reason why you wouldn't want them to start someone during the period between November and the end of Decemeber? That comes across as the main issue.

Thank you for the replies. No, no issue from me on my part. I’d prefer it if they could start immediately and be paid for it. The person who is likely to get the job had wondered and I didn’t know if two people could technically be in post at once.

If the school can afford it, it would make excellent sense for the new teacher to take over the class and for you to be used for cover, intervention, etc. It also means that if your illness drags on or recurs, there's less disruption.

If they can't afford it, but the person concerned would be willing to do any supply for that class in the meantime, that would also be helpful.

If you actually want "out" sooner than December, it's worth mentioning to the school that you would be willing to be released from contract sooner if the new appointee is available to start sooner. However you are entitled to stay and be paid until the end of December, regardless of whether they have appointed anyone and regardless of any further periods of sick leave, so don't feel pushed into it. Contracts can end at non-standard times, but only by mutual agreement.
