In year application sch closure advice

Advice please , A long story short my child’s private school suddenly closed down , so made a ‘ in year application’ also very late this happened start of sept I put two schools down out of three in the area as I’d already managed to get through on the phone to the third who said they were full.
Anyway application just came back saying first two are full and they've offered a really awful school quite far away out of town I obviously won’t be accepting this so I called round again and the original third full school says now it has a place as a student left last week . So I rang the LA but got told the current application couldn’t be edited or anything and to make a new one listing the one school so I have, but have I been told the correct advice as obviously have a application still on there which I can’t edit says to contact them to make changes on the one they’ve offered the bad school . My child has undiagnosed emotional needs etc so will not go in the transport they provide and I’m not putting them through that also the offered school is the roughest around so please don’t say accept the place as it’s not a option . My plan is to home school until a suitable place becomes available as I’m on waiting list for first two choices (2nd & 3rd)
so my question is will it be possible for them to process the new application for same child there’s already one on there for now the third school says there is a place but I have to go through LA . I did tell them on phone the situation and I won’t be accepting where they've offered but they didn’t seem to care and said I have to let 7 days pass or something they can’t put down I’m not accepting. To be honest the person I spoke to sounded new as didn’t really know what to say and I’m wondering if I need to try and speak to someone else or just leave it now

They have offered a place, although it’s not what you want. I think that, if you turn it down, they have no further obligation to you because they have made an offer.

If you are happy with home education, turn the place down, and make a new application.

If you reject the place offered, they don't have to come up with an alternative offer. You can, however, go on waiting lists and see what comes up that way.

You have the right to apply for any school at any time, although some LAs like to behave as if this isn't true. However, there is a good chance the person you spoke to was a junior employee who may have given you poor advice.

Accept the place then appeal. If they've offered you a place then they have no further obligation to you.

For clarity, if OP rejects the offered place the LA does not have to come up with an alternative, but they must still hear any appeal and put her child on the waiting lists for the schools for which she has applied (assuming waiting lists are being operated for these schools).

Im already on the waiting lists for the two I put down my question was can they look at the new application now I’ve spoken to a school that has a place and offer that ?

You should list all three (or more) schools in order of preference..They will offer the highest preference school that has a place..If none have a place, they will offer an alternative. If you reject the alternative they don't have to make you another offer. You can appeal for any school that rejects you, and if the appeals fail, you can stay on their waiting lists until a place comes up.

The mistake you made was not putting your preferred school on the original application, hence the need to add it now.

Yes well it was my third choice but I didn’t put it on as I got through to them at the start of sept and they said they were full hence why I didn’t put it on. I will home school until a suitable place becomes available thanks all

Yes, they can. Indeed, they must.

There are several people on this thread saying the LA don't have to make another offer. That is only partly true. If you reject the offered place and don't do anything else, the LA don't have to make an alternative offer to you. However, if you submit a fresh application naming different schools, they must process that application. If any of those schools has a place available, it must be offered to you.
