In-year application to new state primary

My DS (6) has had a torrid few years at school. He has no diagnosis but has been served four fixed-term exclusions from his state primary school for emotional dysregulation. School and the Govs are not particularly supportive or empathetic, nor are they doing the things they say they will in order to support my child and prevent further exclusions. I have just applied for an in-year transfer to another state primary in the Borough because I think the situation at our current school is, frankly, toxic. Can the state school to which I’ve applied refuse a place for him based on his previous exclusions?

If they think your son has challenging behaviour and they already have a particularly high proportion of children with challenging behaviour compared to other local schools, they can refuse to admit him. However, if they do, you will have the right to appeal that decision.

Does the school have a place available? If they already have 30 per class, they are unlikely to offer your son a place even if there were no fixed-term exclusions.
