Q for Teachers - Calculating Holiday Entitlement when working Term Time Only

Does anyone know how you calculate Holiday Entitlement when the employee is working Term Time only (eg. working 36 weeks per year).

Holiday Entitlement is changing from 1st October 2007, to 4.8 weeks, from 4 weeks.

The FAQ gives a method of calculating holiday entitlement when working Term Time Only, but I either get the same figure, or a lower figure, so I think I am doing something wrong.

Anyone know how holiday entitlement is calculated for term time only employees?

You just need to pro-rata it.
If you work 36 weeks per year (most schools do about 39 weeks) then you work for 36/52 of the yr, i.e. 69.2% of the yr. So you should be entitled to minimum of 14 days paid holiday of those days. (69.2% x 4 weeks [20 days]).

If you work for 36 weeks of the yr, then you could have a contract for 39 weeks of the yr, 3 weeks of which would be paid hols.

But if you only work term-time, you miss most of the bank hols, so could argue your case for pro-rata-ing those in too.

It would depend on your contract. Teachers are paid pro rato term time only but split over 12 months and we're not entitled to any paid holiday. We're actually not paid for any of the school holidays

I work term time only (in NHS) and basically have 13 weeks off / yr. 7 of which are unpaid.

I work term time only in NHS too and my pay is annualised ie spread equally over the 52 weeks of the year. This then means I'm paid when off for 13 weeks.

Our playgroup staff have the same system too - their pay is annualised and then paid over 12 months, even though they only work 39 weeks. That's just so they don't get a few months of the year when they don't get paid at all.

To be honest, it's a bit disingenuous for teachers to say they aren't paid for holidays. Any job offers a package - salary, holidays, pension, perhaps car or whatever. So a teachers' package includes their salary and their working hours, and effectively their longer holidays. It's exactly the same in the pre-school sector and yet I've never heard any pre-school staff say they don't get paid holidays. To my mind, if you have an annualised salary paid over 12 months you're in the same position as most other employees who have a monthly salary and have to work a set number of hours per month or per year.

With teachers'salaries, there is a standard payscale. This is how much money you get, whether it is paid over 12 months, or paid over 10 months.
