Item damaged in post - buyer wants part refund - wwyd?

I sold a breast pump, complete with all accessories and some extra bits (I had to buy new parts for it while I was using it), some new, some used. Sent item first class and it went missing, then arrived at buyer's address with the outer box I had packed it in missing and one of the 'hygienikits' (set of bits you use to get the milk out of one breast) also missing, as well as a few of the extra bits (buyer sent me photos). The buyer would need to buy one new hygienikit to use the machine - they are £13.50.

Buyer has requested a part refund of the price of two hygienikits, on the basis that I will claim refund from Royal Mail. (Parcel did not have extra insurance as it only sold for £40). This would mean me refunding her £27. (I specified in the listing that the buyer might want to buy new hygienikits anyway as they were all used.)

My partner thinks I should say 'Thanks for the photos, I'll put in the claim and give you a part refund when I get the money'. I'm worried about getting into a fight though! Any thoughts...?

An awful lot of things go missing that have been sent to ebay buyers.

I'd refund for 1 as this is what she had part-paid for. 2's taking the micky. It's irrelevant whether you get a refund from royal mail, tell her that she had not paid for insurance.

thanks belledechocolate. that was my thought originally, to refund for 1. But partner says it is not my fault it got damaged... He is hard hearted though

It's not your fault, it's the reasonable thing to do though, I wouldn't refund any more then what was in the kit though.

It's risky selling things on eBay due to the vast amounts of people who claim not to recieve/recieve 'damaged' goods.

Legally seller is responsible though until item delivered? I would only refund items that were actually damaged and paid for.

Yes belledec, I kind of feel it is reasonable too. I worry about getting into some prolonged 'case' though if buyer doesn't like the suggestion. I have seen on other threads people saying 'return the entire item for a refund'...? Could re-sell it then I guess?

It's up to you. You can either refund one or ask her to send it all back to you so you can resell it and give her a refund. Don't give her money for any extras though.
