Ok so i bought an item

seller says it was posted on the 5th May but i have not got it yet.....I have sent her 5 messages and finally got a reply which says she did post it on the 5th has proof of second class post and she is sorry but she has been on holiday, it should be with me by now.

I haven't got it so am a bit peeved off wwyd?

Well second class can be a bit hit and miss - I have had items take this long to arrive. I would give it another week. In the meantime, I would email her and say you will wait until such and such a date and then if you still haven't received the item, you would like your money back. Tell her that you will send her written confirmation that you have not received your item that she can print out and include in her claim for compensation with Royal Mail. Be very polite. If she says she won't compensate and denies it's her problem, then you can get a bit nastier and say unfortunately it is her problem and you will have to open a dispute with paypal if she doesn't comply.

Tomorrow morning, I would also ring your local sorting office (the number probably won't be in the phone book so get it directly from your local friendly post office - don't bother your arse ringing Royal Mail's 0845 number). It might be that the Royal Mail tried to deliver and forgot to leave a card. I rang our sorting office last week to enquire about a missing item of post; they denied black's white ever seeing it. However, at 7am the next morning, there was a knock on the door from the postman clutching my missing parcel....

3 times in the last year they've forgotton to put the card through my door, fortunately we live a 5 minute walk from the sorting office. All 3 times they've said I must be mistaken!!! I've also had a parcel stolen either from my doorstep or out of the unattended posties trolley thing.

I think after 14 days the seller can claim back the money from royal mail.

The problem is that so many ebay buyers are claiming that their items have gone missing and thus getting their money back (thus getting their items free of charge). So if you are an honest person and your item genuinely does go missing, the seller doesn't believe you!

Ask her for the tracking number so you can input it yourself on royalmail.com to reassure yourself where the item is.

Update on this.
The Seller cannot provide me with a tracking number, item still not recieved, she is refusing to refund and also being quite narky and rude.
She photographed a reciept from the post office where she had written my postcode on it. My problem is that the postcode could have been added at any time - not proving it is for the item she has supposedly sent me.

I have opened a case on ebay and she is still refusing to budge on her decision.

Unless she can prove to ebay/paypal that the parcel was delivered to you, then paypal will refund your money. She doesn't have a say in it.

You'll get your money back for sure, Paypal can't do anything but really. The onus is on the seller to prove delivery (via tracking number) and as she didn't post it that way she hasn't a leg to stand on.

Without a tracking number, paypal will find in your favour and refund regardless of what she says. In fact, even if she had a photo of you with the item and a big sign saying, "haha, I've got your stuff!" they would still probably find in your favour.

She can make a claim from RM for the lost item with her receipt.

She was probably trying to get you to wait until the deadline for opening a dispute [cynical smilie]

In the end, I sympathise with both of you. Your parcel is missing which isn't your fault but she clearly posted it and it isn't her fault either. I sell quite a bit on ebay and have had quite a few parcels go missing which is why I nearly always send recorded these days (definitely do for items that sell for more than a few quid).

However, I still see listings where the seller has written that he/she takes no responsibility for items missing in the post and will provide proof of postage if need be so buyer can claim compensation.

Doesn't matter what they write on their listings though tryharder does it, as PP will always find in favour of buyer in these cases. Annoys me when sellers write that as they obviously know nothing about Ebay

The post office normally write the postcode on the proof receipt. At least they do when I post eBay items. It's the only way of doing it I think for standard postage.

Is is a lightweight dress though? I'm surprised it could go second class.

have you started a paypal dispute or an ebay one? i always go with pp and escalute straight away to a claim.

you WILL get your money back, as its upto the seller to ensure it arries and not you

You best open a dispute before it's too late, there is a time limit, though not sure what it is, but a month has nearly gone by already.

Even if she sent it by second class post though, she is covered for all but two quid.

She is being an arse, I sell lots on e-bay and have had a few things go 'missing' and had to claim.

As the recipient you will have to sign a letter sent to you by RM to say you didn't recieve the parcel for her to be able to claim her money back after she has refunded you so she would do well not to piss you off by being rude and difficult.

I had a claim started with Ebay and this morning I recieved a refund for the full amount including postage.

Now back to looking for a wedding dress like that that i can customize as planned....
